 A BILL TO BE ENTITLED
 AN ACT
 relating to the selection of the presiding officer of the Texas
 Medical Board.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 152.008, Occupations Code, is amended to
 read as follows:
 Sec. 152.008. OFFICERS. (a) Not later than December after
 each regular session of the legislature, the governor shall appoint
 from the members of the board a president, to serve in that capacity
 at the pleasure of the governor. Notwithstanding any other law or
 rule, any member of the board is eligible for appointment as
 president of the board under this subsection.
 (b) The [, and the] board shall elect from its members a vice
 president, secretary-treasurer, and other officers as are
 required, in the board's opinion, to carry out the board's duties.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
