66 AN ACT
77 relating to the selection of the presiding officer of the Texas
88 Medical Board.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 152.008, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 152.008. OFFICERS. (a) Not later than December after
1313 each regular session of the legislature, the governor shall appoint
1414 from the members of the board a president, to serve in that capacity
1515 at the pleasure of the governor. Notwithstanding any other law or
1616 rule, any member of the board is eligible for appointment as
1717 president of the board under this subsection.
1818 (b) The [, and the] board shall elect from its members a vice
1919 president, secretary-treasurer, and other officers as are
2020 required, in the board's opinion, to carry out the board's duties.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2009.
