55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing a middle school allotment under the public
88 school finance system to fund programs to encourage preparation for
99 high school.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter F, Chapter 39, Education Code, is
1212 amended by adding Section 39.1141 to read as follows:
1313 Sec. 39.1141. MIDDLE SCHOOL ALLOTMENT. (a) A school
1414 district or campus must use funds allocated under Section
1515 42.2516(b)(4) to:
1616 (1) implement or administer a high school readiness
1717 program that provides academic support and instruction to prepare
1818 underachieving students for entrance into high school;
1919 (2) implement or administer a program that provides
2020 assistance to underachieving students in mathematics and science
2121 course work to prepare those students for high school level
2222 curriculum and expectations;
2323 (3) implement or administer a program that provides
2424 students who have received a failing grade in an academic course the
2525 opportunity to advance and enroll in an intensive program of
2626 instruction to enable the student to retake the course and receive a
2727 passing grade; or
2828 (4) implement or administer a program that encourages
2929 underachieving students to enroll in a career and technology
3030 education program.
3131 (b) An open-enrollment charter school is entitled to an
3232 allotment under this section in the same manner as a school
3333 district.
3434 (c) The commissioner shall adopt rules to administer this
3535 section, including rules related to the permissible use of funds
3636 allocated under this section to an open-enrollment charter school.
3737 SECTION 2. Section 42.2516(b), Education Code, is amended
3838 to read as follows:
3939 (b) Subject to Subsections (b-1), (b-2), (f-1), (g), and
4040 (h), but notwithstanding any other provision of this title, a
4141 school district is entitled to state revenue necessary to provide
4242 the district with the sum of:
4343 (1) the amount of state revenue necessary to maintain
4444 state and local revenue per student in weighted average daily
4545 attendance in the amount equal to the greater of:
4646 (A) the amount of state and local revenue per
4747 student in weighted average daily attendance for the maintenance
4848 and operations of the district available to the district for the
4949 2005-2006 school year;
5050 (B) the amount of state and local revenue per
5151 student in weighted average daily attendance for the maintenance
5252 and operations of the district to which the district would have been
5353 entitled for the 2006-2007 school year under this chapter, as it
5454 existed on January 1, 2006, or, if the district would have been
5555 subject to Chapter 41, as that chapter existed on January 1, 2006,
5656 the amount to which the district would have been entitled under that
5757 chapter, based on the funding elements in effect for the 2005-2006
5858 school year, if the district imposed a maintenance and operations
5959 tax at the rate adopted by the district for the 2005 tax year; or
6060 (C) the amount of state and local revenue per
6161 student in weighted average daily attendance for the maintenance
6262 and operations of the district to which the district would have been
6363 entitled for the 2006-2007 school year under this chapter, as it
6464 existed on January 1, 2006, or, if the district would have been
6565 subject to Chapter 41, as that chapter existed on January 1, 2006,
6666 the amount to which the district would have been entitled under that
6767 chapter, based on the funding elements in effect for the 2005-2006
6868 school year, if the district imposed a maintenance and operations
6969 tax at the rate equal to the rate described by Section 26.08(i) or
7070 (k)(1), Tax Code, as applicable, for the 2006 tax year;
7171 (2) an amount equal to the product of $2,500
7272 multiplied by the number of classroom teachers, full-time
7373 librarians, full-time counselors certified under Subchapter B,
7474 Chapter 21, and full-time school nurses employed by the district
7575 and entitled to a minimum salary under Section 21.402; [and]
7676 (3) an amount equal to the product of $275 multiplied
7777 by the number of students in average daily attendance in grades nine
7878 through 12 in the district; and
7979 (4) an amount equal to the product of $275 multiplied
8080 by the number of students in average daily attendance in grades
8181 seven and eight in the district.
8282 SECTION 3. This Act takes effect September 1, 2009.
