55 AN ACT
66 relating to authorizing the issuance of revenue bonds for The
77 University of Texas - Pan American.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1010 amended by adding Section 55.17522 to read as follows:
1111 Sec. 55.17522. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
1212 BONDS. (a) In addition to the other authority granted by this
1313 subchapter, the board of regents of The University of Texas System
1414 may acquire, purchase, construct, improve, renovate, enlarge, or
1515 equip property, buildings, structures, or other facilities,
1616 including roads and related infrastructure, for projects at The
1717 University of Texas - Pan American, to be financed by the issuance
1818 of bonds in accordance with this subchapter and in accordance with a
1919 systemwide revenue financing program adopted by the board not to
2020 exceed the following aggregate principal amounts for the projects
2121 specified as follows:
2222 (1) $1.5 million for the Starr County Upper Level Center;
2323 and
2424 (2) $29,954,000 for the fine arts academic and performance
2525 complex.
2626 (b) The board may pledge irrevocably to the payment of bonds
2727 authorized by Subsection (a) all or any part of the revenue funds of
2828 an institution, branch, or entity of The University of Texas
2929 System, including student tuition charges. The amount of a pledge
3030 made under this subsection may not be reduced or abrogated while the
3131 bonds for which the pledge is made, or bonds issued to refund those
3232 bonds, are outstanding.
3333 (c) If sufficient funds are not available to the board to
3434 meet its obligations under this section, the board may transfer
3535 funds among institutions, branches, and entities of The University
3636 of Texas System to ensure the most equitable and efficient
3737 allocation of available resources for each institution, branch, or
3838 entity to carry out its duties and purposes.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
