66 AN ACT
77 relating to exemptions from the sales tax for certain school
88 supplies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 151.327, Tax Code, is amended to read as
1111 follows:
1212 Sec. 151.327. SCHOOL SUPPLIES [BACKPACKS] BEFORE START OF
1313 SCHOOL. (a) The sale or storage, use, or other consumption of [a]
1414 school supplies [backpack] is exempted from the taxes imposed by
1515 this chapter if the school supplies are [backpack is] purchased:
1616 (1) for use by a student in a public or private
1717 elementary or secondary school;
1818 (2) during the period described by Section
1919 151.326(a)(2); and
2020 (3) for a sales price of less than $100.
2121 (b) A retailer is not required to obtain an exemption
2222 certificate stating that school supplies [backpacks] are purchased
2323 for use by students in a public or private elementary or secondary
2424 school unless the supplies [backpacks] are purchased in a quantity
2525 that indicates that the supplies [backpacks] are not purchased for
2626 use by students in a public or private elementary or secondary
2727 school.
2828 (c) For purposes of this exemption, "school supplies"
2929 means:
3030 (1) backpacks;
3131 (2) binders;
3232 (3) blackboard chalk;
3333 (4) calculators;
3434 (5) cellophane tape;
3535 (6) compasses;
3636 (7) composition books;
3737 (8) crayons;
3838 (9) erasers;
3939 (10) folders, including expandable, pocket, plastic,
4040 and manila folders;
4141 (11) glue, paste, and glue sticks;
4242 (12) highlighters;
4343 (13) index cards;
4444 (14) index card boxes;
4545 (15) legal pads;
4646 (16) lunch boxes;
4747 (17) markers;
4848 (18) notebooks;
4949 (19) paper, including loose-leaf ruled notebook
5050 paper, copy paper, graph paper, tracing paper, manila paper,
5151 colored paper, poster board, and construction paper;
5252 (20) pencils;
5353 (21) pencil boxes and other school supply boxes;
5454 (22) pencil sharpeners;
5555 (23) pens;
5656 (24) protractors;
5757 (25) rulers;
5858 (26) scissors; and
5959 (27) writing tablets.
6060 SECTION 2. The change in law made by this Act does not
6161 affect taxes imposed before the effective date of this Act, and the
6262 law in effect before the effective date of this Act is continued in
6363 effect for purposes of the liability for and collection of those
6464 taxes.
6565 SECTION 3. This Act takes effect July 1, 2009, if it
6666 receives a vote of two-thirds of all the members elected to each
6767 house, as provided by Section 39, Article III, Texas Constitution.
6868 If this Act does not receive the vote necessary for effect on that
6969 date, this Act takes effect October 1, 2009.
