7 | 7 | | relating to exemptions from the sales tax for certain school |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 151.327, Tax Code, is amended to read as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | Sec. 151.327. SCHOOL SUPPLIES [BACKPACKS] BEFORE START OF |
---|
13 | 13 | | SCHOOL. (a) The sale or storage, use, or other consumption of [a] |
---|
14 | 14 | | school supplies [backpack] is exempted from the taxes imposed by |
---|
15 | 15 | | this chapter if the school supplies are [backpack is] purchased: |
---|
16 | 16 | | (1) for use by a student in a public or private |
---|
17 | 17 | | elementary or secondary school; |
---|
18 | 18 | | (2) during the period described by Section |
---|
19 | 19 | | 151.326(a)(2); and |
---|
20 | 20 | | (3) for a sales price of less than $100. |
---|
21 | 21 | | (b) A retailer is not required to obtain an exemption |
---|
22 | 22 | | certificate stating that school supplies [backpacks] are purchased |
---|
23 | 23 | | for use by students in a public or private elementary or secondary |
---|
24 | 24 | | school unless the supplies [backpacks] are purchased in a quantity |
---|
25 | 25 | | that indicates that the supplies [backpacks] are not purchased for |
---|
26 | 26 | | use by students in a public or private elementary or secondary |
---|
27 | 27 | | school. |
---|
28 | 28 | | (c) For purposes of this exemption, "school supplies" |
---|
29 | 29 | | means: |
---|
30 | 30 | | (1) backpacks; |
---|
31 | 31 | | (2) binders; |
---|
32 | 32 | | (3) blackboard chalk; |
---|
33 | 33 | | (4) calculators; |
---|
34 | 34 | | (5) cellophane tape; |
---|
35 | 35 | | (6) compasses; |
---|
36 | 36 | | (7) composition books; |
---|
37 | 37 | | (8) crayons; |
---|
38 | 38 | | (9) erasers; |
---|
39 | 39 | | (10) folders, including expandable, pocket, plastic, |
---|
40 | 40 | | and manila folders; |
---|
41 | 41 | | (11) glue, paste, and glue sticks; |
---|
42 | 42 | | (12) highlighters; |
---|
43 | 43 | | (13) index cards; |
---|
44 | 44 | | (14) index card boxes; |
---|
45 | 45 | | (15) legal pads; |
---|
46 | 46 | | (16) lunch boxes; |
---|
47 | 47 | | (17) markers; |
---|
48 | 48 | | (18) notebooks; |
---|
49 | 49 | | (19) paper, including loose-leaf ruled notebook |
---|
50 | 50 | | paper, copy paper, graph paper, tracing paper, manila paper, |
---|
51 | 51 | | colored paper, poster board, and construction paper; |

52 | 52 | | (20) pencils; |
---|
53 | 53 | | (21) pencil boxes and other school supply boxes; |
---|
54 | 54 | | (22) pencil sharpeners; |
---|
55 | 55 | | (23) pens; |
---|
56 | 56 | | (24) protractors; |
---|
57 | 57 | | (25) rulers; |
---|
58 | 58 | | (26) scissors; and |
---|
59 | 59 | | (27) writing tablets. |

60 | 60 | | SECTION 2. The change in law made by this Act does not |
---|
61 | 61 | | affect taxes imposed before the effective date of this Act, and the |
---|
62 | 62 | | law in effect before the effective date of this Act is continued in |
---|
63 | 63 | | effect for purposes of the liability for and collection of those |
---|
64 | 64 | | taxes. |
---|
65 | 65 | | SECTION 3. This Act takes effect July 1, 2009, if it |
---|
66 | 66 | | receives a vote of two-thirds of all the members elected to each |
---|
67 | 67 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
68 | 68 | | If this Act does not receive the vote necessary for effect on that |
---|
69 | 69 | | date, this Act takes effect October 1, 2009. |
