9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 707.002, Transportation Code, is amended | |
11 | 11 | to read as follows: | |
12 | 12 | Sec. 707.002. AUTHORITY TO PROVIDE FOR CIVIL PENALTY. (a) | |
13 | 13 | The governing body of a local authority by ordinance may implement a | |
14 | 14 | photographic traffic signal enforcement system and except as | |
15 | 15 | provided by Subsection (b), provide that the owner of a motor | |
16 | 16 | vehicle is liable to the local authority for a civil penalty if, | |
17 | 17 | while facing only a steady red signal displayed by an electrically | |
18 | 18 | operated traffic-control signal located in the local authority, the | |
19 | 19 | vehicle is operated in violation of the instructions of that | |
20 | 20 | traffic-control signal, as specified by Section 544.007(d). | |
21 | 21 | (b) An ordinance adopted under Subsection (a) may not | |
22 | 22 | provide for the imposition of a civil penalty if the vehicle was | |
23 | 23 | turning right or left at an intersection and failed to stop at a | |
24 | 24 | stop line or before entering the crosswalk on the near side of the | |
25 | 25 | intersection. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2009. |
