44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to coverage under an automobile insurance policy for
77 certain family members.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1952.056, Insurance Code, is amended to
1010 read as follows:
1111 Sec. 1952.056. REQUIRED PROVISION: COVERAGE FOR CERTAIN
1212 SPOUSES AND FAMILY MEMBERS. A personal automobile insurance policy
1313 or any similar policy form adopted or approved by the commissioner
1414 under Article 5.06 or filed under Subchapter B, Chapter 2301, that
1515 covers liability arising out of ownership, maintenance, or use of a
1616 motor vehicle shall:
1717 (a) provide continuing coverage for a spouse during a period
1818 of separation in contemplation of divorce; and
1919 (b) not exclude from coverage any other family member of the
2020 insured, including any person who is related by blood, adoption or
2121 marriage and who resides in the named insured's household. [of a
2222 spouse who is otherwise insured by the policy must contain a
2323 provision to continue coverage for the spouse during a period of
2424 separation in contemplation of divorce.]
2525 SECTION 2. This Act applies only to an action commenced on
2626 or after the effective date of this Act. An action that is
2727 commenced before the effective date of this Act is governed by the
2828 law applicable to the action immediately before the effective date
2929 of this Act, and that law in continued in effect for that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
