| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1952.056, Insurance Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 1952.056. REQUIRED PROVISION: COVERAGE FOR CERTAIN |
|---|
| 12 | 12 | | SPOUSES AND FAMILY MEMBERS. A personal automobile insurance policy |
|---|
| 13 | 13 | | or any similar policy form adopted or approved by the commissioner |
|---|
| 14 | 14 | | under Article 5.06 or filed under Subchapter B, Chapter 2301, that |
|---|
| 15 | 15 | | covers liability arising out of ownership, maintenance, or use of a |
|---|
| 16 | 16 | | motor vehicle shall: |
|---|
| 17 | 17 | | (a) provide continuing coverage for a spouse during a period |
|---|
| 18 | 18 | | of separation in contemplation of divorce; and |
|---|
| 19 | 19 | | (b) not exclude from coverage any other family member of the |
|---|
| 20 | 20 | | insured, including any person who is related by blood, adoption or |
|---|
| 21 | 21 | | marriage and who resides in the named insured's household. [of a |
|---|
| 22 | 22 | | spouse who is otherwise insured by the policy must contain a |
|---|
| 23 | 23 | | provision to continue coverage for the spouse during a period of |
|---|
| 24 | 24 | | separation in contemplation of divorce.] |
|---|
| 25 | 25 | | SECTION 2. This Act applies only to an action commenced on |
|---|
| 26 | 26 | | or after the effective date of this Act. An action that is |
|---|
| 27 | 27 | | commenced before the effective date of this Act is governed by the |
|---|
| 28 | 28 | | law applicable to the action immediately before the effective date |
|---|
| 29 | 29 | | of this Act, and that law in continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
