| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 36.122, Subchapter D, Chapter 36, Water |
|---|
| 10 | 10 | | Code, is amended by adding Subsection (i) to read as follows: |
|---|
| 11 | 11 | | (j) Public water supply projects recognized in the State |
|---|
| 12 | 12 | | Water Plan or an approved regional water plan and supplying water to |
|---|
| 13 | 13 | | water utilities by a water conveyance constructed to convey water |
|---|
| 14 | 14 | | from one or more permitted water supply wells are entitled to |
|---|
| 15 | 15 | | receive permits to construct, produce and transport water from |
|---|
| 16 | 16 | | groundwater conservation districts in an amount sufficient to meet |
|---|
| 17 | 17 | | the design capacity of the conveyance system. Notwithstanding any |
|---|
| 18 | 18 | | other provisions of this chapter, the permits or series of permits |
|---|
| 19 | 19 | | required for the continuous operation of the water supply project |
|---|
| 20 | 20 | | at its design capacity shall be issued in accord with the orders, |
|---|
| 21 | 21 | | regulations, ordinances, rules, plans, or other properly adopted |
|---|
| 22 | 22 | | requirements of the regulating districts(s) in effect at the time |
|---|
| 23 | 23 | | the water supply conveyance is constructed. For regulatory |
|---|
| 24 | 24 | | purposes, artesian water level drawdown shall be computed as a |
|---|
| 25 | 25 | | district wide average and must be measured outside the property |
|---|
| 26 | 26 | | controlled by the permittee. All permits required for the |
|---|
| 27 | 27 | | continuous operation of the water supply project at its design |
|---|
| 28 | 28 | | capacity are considered to be a single series of permits and shall |
|---|
| 29 | 29 | | be in effect for the period required by Section 36.122(i) from and |
|---|
| 30 | 30 | | after the issuance of the final permit in the single series of |
|---|
| 31 | 31 | | permits. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
