55 AN ACT
66 relating to the issuance of a permit to a local government
77 corporation for a public water supply project.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 36.122, Subchapter D, Chapter 36, Water
1010 Code, is amended by adding Subsection (i) to read as follows:
1111 (j) Public water supply projects recognized in the State
1212 Water Plan or an approved regional water plan and supplying water to
1313 water utilities by a water conveyance constructed to convey water
1414 from one or more permitted water supply wells are entitled to
1515 receive permits to construct, produce and transport water from
1616 groundwater conservation districts in an amount sufficient to meet
1717 the design capacity of the conveyance system. Notwithstanding any
1818 other provisions of this chapter, the permits or series of permits
1919 required for the continuous operation of the water supply project
2020 at its design capacity shall be issued in accord with the orders,
2121 regulations, ordinances, rules, plans, or other properly adopted
2222 requirements of the regulating districts(s) in effect at the time
2323 the water supply conveyance is constructed. For regulatory
2424 purposes, artesian water level drawdown shall be computed as a
2525 district wide average and must be measured outside the property
2626 controlled by the permittee. All permits required for the
2727 continuous operation of the water supply project at its design
2828 capacity are considered to be a single series of permits and shall
2929 be in effect for the period required by Section 36.122(i) from and
3030 after the issuance of the final permit in the single series of
3131 permits.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
