5	5	relating to a transportation plan for persons furloughed or
6	6	discharged from certain mental health facilities.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subchapter F, Chapter 574, Health and Safety
9	9	Code, is amended by adding Section 574.089 to read as follows:
10	10	Sec. 574.089. TRANSPORTATION PLAN FOR FURLOUGH OR
11	11	DISCHARGE. (a) The facility administrator of a mental health
12	12	facility, in conjunction with the local mental health authority,
13	13	shall create a transportation plan for a person scheduled to be
14	14	furloughed or discharged from the facility.
15	15	(b) The transportation plan must account for the capacity of
16	16	the person, must be in writing, and must specify:
17	17	(1) who is responsible for transporting the person;
18	18	(2) when the person will be transported; and
19	19	(3) where the person will arrive.
20	20	(c) If the person consents, the facility administrator
21	21	shall forward the transportation plan to a family member of the
22	22	person before the person is transported.
23	23	SECTION 2. This Act takes effect September 1, 2009.
