| 6 | 6 | | relating to the duties of the transportation commission. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 201.103, Transportation Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (a) The director [commission], under the direction and the |
|---|
| 11 | 11 | | approval of the commission shall [plan and make policies for the |
|---|
| 12 | 12 | | location, construction, and maintenance of a comprehensive system |
|---|
| 13 | 13 | | of state highways and public roads] submit to the legislature for |
|---|
| 14 | 14 | | approval, by February 1st of each odd year, its recommendations for |
|---|
| 15 | 15 | | a two year comprehensive strategic highway system plan. |
|---|
| 16 | 16 | | (b) The plan required by Subsection (a) shall include: |
|---|
| 17 | 17 | | (1) the location, construction, and maintenance of |
|---|
| 18 | 18 | | state highways and public; and |
|---|
| 19 | 19 | | (2) recommendations submitted by metropolitan |
|---|
| 20 | 20 | | planning organization as defined by Section 472.031. |
|---|
| 21 | 21 | | [(b)] (c) The commission shall designate as part of the |
|---|
| 22 | 22 | | state highway system a highway that it determines is necessary for |
|---|
| 23 | 23 | | the proper development and operation of the system. The commission |
|---|
| 24 | 24 | | may remove a segment of the state highway system that it determines |
|---|
| 25 | 25 | | is not needed for the system. In planning and making policies, the |
|---|
| 26 | 26 | | commission shall consider, for incorporation into the state highway |
|---|
| 27 | 27 | | system, turnpikes that other governmental or private entities are |
|---|
| 28 | 28 | | authorized to construct. |
|---|
| 29 | 29 | | [(c)] (d) The commission biennially shall submit a report of |
|---|
| 30 | 30 | | its work to the governor and the legislature. [The report must |
|---|
| 31 | 31 | | include the recommendations of the commission and of the director. |
|---|
| 32 | 32 | | [(d) The director, under the direction and with the approval |
|---|
| 33 | 33 | | of the commission, shall prepare a comprehensive plan providing a |
|---|
| 34 | 34 | | system of state highways.] |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
