55 AN ACT
66 relating to the duties of the transportation commission.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 201.103, Transportation Code, is amended
99 to read as follows:
1010 (a) The director [commission], under the direction and the
1111 approval of the commission shall [plan and make policies for the
1212 location, construction, and maintenance of a comprehensive system
1313 of state highways and public roads] submit to the legislature for
1414 approval, by February 1st of each odd year, its recommendations for
1515 a two year comprehensive strategic highway system plan.
1616 (b) The plan required by Subsection (a) shall include:
1717 (1) the location, construction, and maintenance of
1818 state highways and public; and
1919 (2) recommendations submitted by metropolitan
2020 planning organization as defined by Section 472.031.
2121 [(b)] (c) The commission shall designate as part of the
2222 state highway system a highway that it determines is necessary for
2323 the proper development and operation of the system. The commission
2424 may remove a segment of the state highway system that it determines
2525 is not needed for the system. In planning and making policies, the
2626 commission shall consider, for incorporation into the state highway
2727 system, turnpikes that other governmental or private entities are
2828 authorized to construct.
2929 [(c)] (d) The commission biennially shall submit a report of
3030 its work to the governor and the legislature. [The report must
3131 include the recommendations of the commission and of the director.
3232 [(d) The director, under the direction and with the approval
3333 of the commission, shall prepare a comprehensive plan providing a
3434 system of state highways.]
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
