77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 121.2015(c) and (d), Utilities Code,
99 are amended to read as follows:
1010 (c) If the operator or operator's representative cannot
1111 arrange a meeting in person after complying with Subsection (b),
1212 the operator or the operator's representative shall [make an effort
1313 to] conduct community liaison activities by [means of a telephone
1414 conference call with the officials by] one of the following
1515 methods:
1616 (1) holding [mailing a written request for] a
1717 telephone conference with [to] the appropriate officials [by
1818 certified mail, return receipt requested]; or
1919 (2) delivering [sending a request for a telephone
2020 conference to the appropriate officials by facsimile transmission;
2121 or
2222 [(3) making one or more telephone calls or e-mail
2323 message transmissions to the appropriate officials to request a
2424 telephone conference.
2525 [(d) If the operator or the operator's representative has
2626 made the efforts required by Subsections (b) and (c) but has not
2727 successfully arranged a meeting in person or a telephone
2828 conference,] the community liaison information required to be
2929 conveyed [may be delivered by mailing the information] by certified
3030 mail, return receipt requested.
3131 SECTION 2. Sections 117.012(i) and (j), Natural Resources
3232 Code, are amended to read as follows:
3333 (i) If the operator or operator's representative cannot
3434 arrange a meeting in person after complying with Subsection (h),
3535 the operator or the operator's representative shall [make an
3636 effort, by one of the following methods, to] conduct community
3737 liaison activities by one of the following methods [means of a
3838 telephone conference call with the officials]:
3939 (1) holding [mailing a written request for] a
4040 telephone conference with [to] the appropriate officials [by
4141 certified mail, return receipt requested]; or
4242 (2) delivering [sending a request for a telephone
4343 conference to the appropriate officials by facsimile transmission;
4444 or
4545 [(3) making one or more telephone calls or e-mail
4646 message transmissions to the appropriate officials to request a
4747 telephone conference.
4848 [(j) If the operator or the operator's representative has
4949 made the efforts required by Subsections (h) and (i) but has not
5050 successfully arranged a meeting in person or a telephone
5151 conference,] the community liaison information required to be
5252 conveyed [may be delivered by mailing the information] by certified
5353 mail, return receipt requested.
5454 SECTION 3. This Act takes effect September 1, 2009.
