5	5	relating to safety rules for certain pipeline facilities and public
6	6	awareness.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Sections 121.2015(c) and (d), Utilities Code,
9	9	are amended to read as follows:
10	10	(c) If the operator or operator's representative cannot
11	11	arrange a meeting in person after complying with Subsection (b),
12	12	the operator or the operator's representative shall [make an effort
13	13	to] conduct community liaison activities by [means of a telephone
14	14	conference call with the officials by] one of the following
15	15	methods:
16	16	(1) holding [mailing a written request for] a
17	17	telephone conference with [to] the appropriate officials [by
18	18	certified mail, return receipt requested]; or
19	19	(2) delivering [sending a request for a telephone
20	20	conference to the appropriate officials by facsimile transmission;
21	21	or
22	22	[(3) making one or more telephone calls or e-mail
23	23	message transmissions to the appropriate officials to request a
24	24	telephone conference.
25	25	[(d) If the operator or the operator's representative has
26	26	made the efforts required by Subsections (b) and (c) but has not
27	27	successfully arranged a meeting in person or a telephone
28	28	conference,] the community liaison information required to be
29	29	conveyed [may be delivered by mailing the information] by certified
30	30	mail, return receipt requested.
31	31	SECTION 2. Sections 117.012(i) and (j), Natural Resources
32	32	Code, are amended to read as follows:
33	33	(i) If the operator or operator's representative cannot
34	34	arrange a meeting in person after complying with Subsection (h),
35	35	the operator or the operator's representative shall [make an
36	36	effort, by one of the following methods, to] conduct community
37	37	liaison activities by one of the following methods [means of a
38	38	telephone conference call with the officials]:
39	39	(1) holding [mailing a written request for] a
40	40	telephone conference with [to] the appropriate officials [by
41	41	certified mail, return receipt requested]; or
42	42	(2) delivering [sending a request for a telephone
43	43	conference to the appropriate officials by facsimile transmission;
44	44	or
45	45	[(3) making one or more telephone calls or e-mail
46	46	message transmissions to the appropriate officials to request a
47	47	telephone conference.
48	48	[(j) If the operator or the operator's representative has
49	49	made the efforts required by Subsections (h) and (i) but has not
50	50	successfully arranged a meeting in person or a telephone
51	51	conference,] the community liaison information required to be
52	52	conveyed [may be delivered by mailing the information] by certified
53	53	mail, return receipt requested.
54	54	SECTION 3. This Act takes effect September 1, 2009.
