7 | 7 | | relating to a study concerning the feasibility and viability of |
---|
8 | 8 | | certain time-differentiated pricing schemes for electric service. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. (a) The independent organization certified |
---|
11 | 11 | | under Section 39.151, Utilities Code, for the ERCOT power region |
---|
12 | 12 | | shall conduct a study concerning the feasibility of the adoption of |
---|
13 | 13 | | time-differentiated pricing, including real-time pricing, critical |
---|
14 | 14 | | peak pricing, and time-of-use pricing schemes, by an investor-owned |
---|
15 | 15 | | electric utility, a retail electric provider, a municipally owned |
---|
16 | 16 | | utility, an electric cooperative, or a river authority that |
---|
17 | 17 | | provides electric utility services. |
---|
18 | 18 | | (b) In conducting the study required by this Act, the |
---|
19 | 19 | | independent organization shall consider: |
---|
20 | 20 | | (1) the current condition of the industry in this |
---|
21 | 21 | | state; |
---|
22 | 22 | | (2) prior studies that have been conducted on the |
---|
23 | 23 | | issue of time-of-use pricing; and |
---|
24 | 24 | | (3) any other information that the independent |
---|
25 | 25 | | organization determines is necessary. |
---|
26 | 26 | | (c) At the independent organization's request, the Public |
---|
27 | 27 | | Utility Commission of Texas or other agency shall provide |
---|
28 | 28 | | information and assistance in conducting the study under this Act. |
---|
29 | 29 | | (d) Not later than January 1, 2011, the independent |
---|
30 | 30 | | organization shall report the results of the study conducted under |
---|
31 | 31 | | this Act to the 82nd Legislature. At a minimum, the report must |
---|
32 | 32 | | include recommendations concerning specific steps that can be |
---|
33 | 33 | | taken, by statute or rule, to achieve maximum consumer and utility |
---|
34 | 34 | | savings by transitioning to time-differentiated pricing in this |
---|
35 | 35 | | state. |
---|
36 | 36 | | SECTION 2. This Act expires January 1, 2011. |
---|
37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
