77 relating to the certification of certain municipal police officers
88 to enforce commercial motor vehicle safety standards.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 644.101(b), Transportation Code, as
1111 amended by Chapters 508 (S.B. 545), 702 (H.B. 2077), and 1030 (H.B.
1212 1638), Acts of the 80th Legislature, Regular Session, 2007, is
1313 reenacted and amended to read as follows:
1414 (b) A police officer of any of the following municipalities
1515 is eligible to apply for certification under this section:
1616 (1) a municipality with a population of 50,000 or
1717 more;
1818 (2) a municipality with a population of 25,000 or more
1919 any part of which is located in a county with a population of
2020 500,000 or more;
2121 (3) a municipality with a population of less than
2222 25,000:
2323 (A) any part of which is located in a county with
2424 a population of 2.4 million; and
2525 (B) that contains or is adjacent to an
2626 international port;
2727 (4) a municipality with a population of at least
2828 34,000 that is located in a county that borders two or more states;
2929 (5) a municipality any part of which is located in a
3030 county bordering the United Mexican States; [or]
3131 (6) a municipality with a population of less than
3232 5,000 that is located:
3333 (A) adjacent to a bay connected to the Gulf of
3434 Mexico; and
3535 (B) in a county adjacent to a county with a
3636 population greater than 3.3 million; or
3737 (7) a municipality with a population of 10,000 or more
3838 that is located in a county:
3939 (A) with a population of less than 100,000; and
4040 (B) that borders the State of Louisiana and the
4141 Gulf Intracoastal Waterway.
4242 SECTION 2. To the extent of any conflict, this Act prevails
4343 over another Act of the 81st Legislature, Regular Session, 2009,
4444 relating to nonsubstantive additions to and corrections in enacted
4545 codes.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
