88 AN ACT
99 relating to the civil and criminal consequences of engaging in
1010 certain conduct involving a firearm and to creating the offense of
1111 firearm smuggling; providing penalties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 46, Penal Code, is amended by adding
1414 Section 46.14 to read as follows:
1515 Sec. 46.14. FIREARM SMUGGLING. (a) A person commits an
1616 offense if the person knowingly engages in the business of
1717 transporting or transferring a firearm that the person knows was
1818 acquired in violation of the laws of any state or of the United
1919 States. For purposes of this subsection, a person is considered to
2020 engage in the business of transporting or transferring a firearm if
2121 the person engages in that conduct:
2222 (1) on more than one occasion; or
2323 (2) for profit or any other form of remuneration.
2424 (b) An offense under this section is a felony of the third
2525 degree, unless it is shown on the trial of the offense that the
2626 offense was committed with respect to three or more firearms in a
2727 single criminal episode, in which event the offense is a felony of
2828 the second degree.
2929 (c) This section does not apply to a peace officer who is
3030 engaged in the actual discharge of an official duty.
3131 (d) If conduct that constitutes an offense under this
3232 section also constitutes an offense under any other law, the actor
3333 may be prosecuted under this section, the other law, or both.
3434 SECTION 2. Section 71.02(a), Penal Code, is amended to read
3535 as follows:
3636 (a) A person commits an offense if, with the intent to
3737 establish, maintain, or participate in a combination or in the
3838 profits of a combination or as a member of a criminal street gang,
3939 the person [he] commits or conspires to commit one or more of the
4040 following:
4141 (1) murder, capital murder, arson, aggravated
4242 robbery, robbery, burglary, theft, aggravated kidnapping,
4343 kidnapping, aggravated assault, aggravated sexual assault, sexual
4444 assault, forgery, deadly conduct, assault punishable as a Class A
4545 misdemeanor, burglary of a motor vehicle, or unauthorized use of a
4646 motor vehicle;
4747 (2) any gambling offense punishable as a Class A
4848 misdemeanor;
4949 (3) promotion of prostitution, aggravated promotion
5050 of prostitution, or compelling prostitution;
5151 (4) unlawful manufacture, transportation, repair, or
5252 sale of firearms or prohibited weapons;
5353 (5) unlawful manufacture, delivery, dispensation, or
5454 distribution of a controlled substance or dangerous drug, or
5555 unlawful possession of a controlled substance or dangerous drug
5656 through forgery, fraud, misrepresentation, or deception;
5757 (6) any unlawful wholesale promotion or possession of
5858 any obscene material or obscene device with the intent to wholesale
5959 promote the same;
6060 (7) any offense under Subchapter B, Chapter 43,
6161 depicting or involving conduct by or directed toward a child
6262 younger than 18 years of age;
6363 (8) any felony offense under Chapter 32;
6464 (9) any offense under Chapter 36;
6565 (10) any offense under Chapter 34 or 35;
6666 (11) any offense under Section 37.11(a);
6767 (12) any offense under Chapter 20A; [or]
6868 (13) any offense under Section 37.10; or
6969 (14) any offense under Section 46.06(a)(1) or 46.14.
7070 SECTION 3. Article 59.01(2), Code of Criminal Procedure, as
7171 amended by Chapters 127 (S.B. 1694), 822 (H.B. 73), and 885 (H.B.
7272 2278), Acts of the 80th Legislature, Regular Session, 2007, is
7373 reenacted and amended to read as follows:
7474 (2) "Contraband" means property of any nature,
7575 including real, personal, tangible, or intangible, that is:
7676 (A) used in the commission of:
7777 (i) any first or second degree felony under
7878 the Penal Code;
7979 (ii) any felony under Section 15.031(b),
8080 20.05, 21.11, 38.04, Subchapter B of Chapter 43, or Chapter 29, 30,
8181 31, 32, 33, 33A, or 35, Penal Code;
8282 (iii) any felony under The Securities Act
8383 (Article 581-1 et seq., Vernon's Texas Civil Statutes); or
8484 (iv) any offense under Chapter 49, Penal
8585 Code, that is punishable as a felony of the third degree or state
8686 jail felony, if the defendant has been previously convicted three
8787 times of an offense under that chapter;
8888 (B) used or intended to be used in the commission
8989 of:
9090 (i) any felony under Chapter 481, Health
9191 and Safety Code (Texas Controlled Substances Act);
9292 (ii) any felony under Chapter 483, Health
9393 and Safety Code;
9494 (iii) a felony under Chapter 153, Finance
9595 Code;
9696 (iv) any felony under Chapter 34, Penal
9797 Code;
9898 (v) a Class A misdemeanor under Subchapter
9999 B, Chapter 365, Health and Safety Code, if the defendant has been
100100 previously convicted twice of an offense under that subchapter;
101101 (vi) any felony under Chapter 152, Finance
102102 Code;
103103 (vii) any felony under Chapter 32, Human
104104 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
105105 involves the state Medicaid program;
106106 (viii) a Class B misdemeanor under Chapter
107107 522, Business & Commerce Code; [or]
108108 (ix) a Class A misdemeanor under Section
109109 35.153, Business & Commerce Code; or
110110 (x) any offense under Section 46.06(a)(1)
111111 or 46.14, Penal Code;
112112 (C) the proceeds gained from the commission of a
113113 felony listed in Paragraph (A) or (B) of this subdivision, a
114114 misdemeanor listed in Paragraph (B)(viii) or (x) of this
115115 subdivision, or a crime of violence;
116116 (D) acquired with proceeds gained from the
117117 commission of a felony listed in Paragraph (A) or (B) of this
118118 subdivision, a misdemeanor listed in Paragraph (B)(viii) or (x) of
119119 this subdivision, or a crime of violence; or
120120 (E) used to facilitate or intended to be used to
121121 facilitate the commission of a felony under Section 15.031 or
122122 43.25, Penal Code.
123123 SECTION 4. The change in law made by this Act applies only
124124 to an offense committed on or after the effective date of this Act.
125125 An offense committed before the effective date of this Act is
126126 governed by the law in effect when the offense was committed, and
127127 the former law is continued in effect for that purpose. For
128128 purposes of this section, an offense was committed before the
129129 effective date of this Act if any element of the offense occurred
130130 before that date.
131131 SECTION 5. The change in law made by this Act in amending
132132 Article 59.01(2), Code of Criminal Procedure, applies only to the
133133 forfeiture of property in relation to an offense committed on or
134134 after the effective date of this Act. Forfeiture of property in
135135 relation to an offense committed before the effective date of this
136136 Act is governed by the law in effect when the offense was committed,
137137 and the former law is continued in effect for that purpose. For
138138 purposes of this section, an offense was committed before the
139139 effective date of this Act if any element of the offense occurred
140140 before that date.
141141 SECTION 6. This Act takes effect September 1, 2009.
