44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to an annual report by the Texas Fusion Center regarding
77 criminal street gangs and gang-related crime.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 421.082, Government Code, is amended by
1010 adding Subsections (d) and (e) to read as follows:
1111 (d) The Texas Fusion Center shall annually submit to the
1212 governor a report regarding criminal street gangs and gang-related
1313 crime. The report must include:
1414 (1) an evaluation of the threat that criminal street
1515 gangs and gang-related crime pose to the infrastructure of the
1616 state, each county, and each municipality with a population of more
1717 than 100,000; and
1818 (2) recommendations on actions that may be taken to:
1919 (A) prevent criminal street gangs from
2020 committing human trafficking offenses;
2121 (B) reduce criminal street gang violence;
2222 (C) prevent the growth and proliferation of
2323 criminal street gangs; and
2424 (D) ensure that law enforcement personnel
2525 receive the necessary training and education to effectively deal
2626 with the problems created by criminal street gangs and gang-related
2727 crime.
2828 (e) On request, the office of the attorney general, the
2929 Department of Public Safety, the Texas Violent Gang Task Force, the
3030 Gang Resource System, criminal justice agencies, and juvenile
3131 justice agencies shall provide information relating to criminal
3232 street gangs and gang-related crime to the Texas Fusion Center.
3333 (f) The center shall perform its duties under circumstances
3434 prescribed by and as directed by the governor's homeland security
3535 strategy.
3636 SECTION 2. The Texas Fusion Center shall submit the first
3737 annual report regarding criminal street gangs and gang-related
3838 crime to the governor as required by Section 421.082(d), Government
3939 Code, as added by this Act, not later than September 1, 2010.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
