| 6 | 6 | | relating to an annual report by the Texas Fusion Center regarding |

| 7 | 7 | | criminal street gangs and gang-related crime. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 421.082, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subsections (d) and (e) to read as follows: |
|---|
| 11 | 11 | | (d) The Texas Fusion Center shall annually submit to the |
|---|
| 12 | 12 | | governor a report regarding criminal street gangs and gang-related |
|---|
| 13 | 13 | | crime. The report must include: |
|---|
| 14 | 14 | | (1) an evaluation of the threat that criminal street |
|---|
| 15 | 15 | | gangs and gang-related crime pose to the infrastructure of the |
|---|
| 16 | 16 | | state, each county, and each municipality with a population of more |
|---|
| 17 | 17 | | than 100,000; and |
|---|
| 18 | 18 | | (2) recommendations on actions that may be taken to: |
|---|
| 19 | 19 | | (A) prevent criminal street gangs from |
|---|
| 20 | 20 | | committing human trafficking offenses; |
|---|
| 21 | 21 | | (B) reduce criminal street gang violence; |
|---|
| 22 | 22 | | (C) prevent the growth and proliferation of |
|---|
| 23 | 23 | | criminal street gangs; and |
|---|
| 24 | 24 | | (D) ensure that law enforcement personnel |
|---|
| 25 | 25 | | receive the necessary training and education to effectively deal |
|---|
| 26 | 26 | | with the problems created by criminal street gangs and gang-related |
|---|
| 27 | 27 | | crime. |
|---|
| 28 | 28 | | (e) On request, the office of the attorney general, the |
|---|
| 29 | 29 | | Department of Public Safety, the Texas Violent Gang Task Force, the |
|---|
| 30 | 30 | | Gang Resource System, criminal justice agencies, and juvenile |
|---|
| 31 | 31 | | justice agencies shall provide information relating to criminal |
|---|
| 32 | 32 | | street gangs and gang-related crime to the Texas Fusion Center. |
|---|
| 33 | 33 | | (f) The center shall perform its duties under circumstances |
|---|
| 34 | 34 | | prescribed by and as directed by the governor's homeland security |
|---|
| 35 | 35 | | strategy. |
|---|
| 36 | 36 | | SECTION 2. The Texas Fusion Center shall submit the first |
|---|
| 37 | 37 | | annual report regarding criminal street gangs and gang-related |
|---|
| 38 | 38 | | crime to the governor as required by Section 421.082(d), Government |
|---|
| 39 | 39 | | Code, as added by this Act, not later than September 1, 2010. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2009. |
