6 | 6 | | relating to the use of certain money in the state highway fund |

7 | 7 | | received from a project or system and held in a subaccount for the |
---|
8 | 8 | | benefit of the region in which the project or system is located. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 228.012(b), Transportation Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) The department shall hold money in a subaccount in trust |
---|
13 | 13 | | for the benefit of the region in which a project or system is |
---|
14 | 14 | | located and may, after any necessary consultation with the |
---|
15 | 15 | | metropolitan planning organization, council of governments or a |
---|
16 | 16 | | similar planning agency for the region, enter into an agreement or |
---|
17 | 17 | | agreements with the municipalities, counties or local governmental |
---|
18 | 18 | | entities in the region for the distribution of money to such |
---|
19 | 19 | | entities in such region that are authorized to construct, maintain, |
---|
20 | 20 | | or operate projects that are eligible for funding with that money. |
---|
21 | 21 | | assign the responsibility for allocating money in a subaccount to a |
---|
22 | 22 | | metropolitan planning organization in which the region is located. |
---|
23 | 23 | | Except as provided by Subsection (c), money shall be allocated to |
---|
24 | 24 | | projects authorized by Section 228.0055 or Section 228.006, as |
---|
25 | 25 | | applicable. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2009. |
