44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to certain license plates issued by the Texas Department
77 of Transportation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 504.401(a) is amended to read as
1010 follows:
1111 Sec. 504.401A. STATE OFFICIALS - EXECUTIVE AND LEGISLATIVE
1212 BRANCHES. (a) The department shall issue without charge specialty
1313 license plates to a state official. The license plates must include
1414 the words "State Official."
1515 (b) A state official may be issued four three sets of
1616 license plates under this section;
1717 (c) The license plates remain valid until December 31 of
1818 each year.
1919 (d) In this section, "state official" means:
2020 (1) a member of the legislature;
2121 (2) the governor;
2222 (3) the lieutenant governor;
2323 (4) a justice of the supreme court;
2424 (5) a judge of the court of criminal appeals;
2525 (6) the attorney general;
2626 (5) (7) the Commissioner of the General Land Office;
2727 (6) (8) the comptroller;
2828 (7) (9) a member of the Railroad Commission of Texas;
2929 (8) (10) the commissioner of agriculture;
3030 (9) (11) the secretary of state; or
3131 (10) (12) a member of the State Board of Education.
3232 SECTION 2. Chapter 504 of the Transportation Code is
3333 amended by adding Section 504.401B to read as follows:
3434 Sec.504.401B - STATE OFFICIALS - JUDICIAL BRANCH. (a) The
3535 department shall issue without charge specialty license plates for
3636 a current state judge. The license plates must include the words
3737 "State Judge."
3838 (b) A person may be issued three sets of plates under this
3939 section.
4040 (c) The license plates remain valid until December 31 of
4141 each year.
4242 (d) In this section, a "state judge" includes:
4343 (1) a justice of the supreme court;
4444 (2) a judge of the court of criminal appeals;
4545 (3) a judge of a court of appeals;
4646 (4) a district court judge;
4747 (5) a presiding judge of an administrative judicial
4848 district; or
4949 (6) a judge of a statutory county court.
5050 SECTION 3. Section 504.402, Transportation Code, is amended
5151 to read as follows:
5252 Sec.504.402A. FEDERAL OFFICIALS - LEGISLATIVE BRANCH. (a)
5353 The department shall issue without charge specialty license plates
5454 for members of congress. License plates issued under this section
5555 must include the words "U.S. Congress."
5656 (b) A person may be issued four three sets of license plates
5757 under this section.
5858 (c) The license plates remain valid until December 31 of
5959 each year.
6060 SECTION 4. Chapter 504 of the Transportation Code is
6161 amended by adding Section 504.402B to read as follows:
6262 Sec.504.402B - FEDERAL OFFICIALS - JUDICIAL BRANCH. (a) The
6363 department shall issue without charge specialty license plates for
6464 a current federal judge. The license plates must include the words
6565 "U.S. Judge."
6666 (b) A person may be issued three sets of plates under this
6767 section.
6868 (c) The license plates remain valid until December 31 of
6969 each year.
7070 (d) In this section, a "federal judge" includes:
7171 (1) a justice of the United States Supreme Court whose
7272 primary residence is in Texas;
7373 (2) a judge of the Fifth Circuit Court of Appeals; or
7474 (3) a judge of a United States district.
7575 SECTION 5. Section 504.403 and Section 504.404,
7676 Transportation Code, are repealed.
7777 SECTION 6. Chapter 504, Transportation Code, is amended by
7878 adding Section 504.403A to read as follows:
7979 Section 504.403A. COUNTY OFFICIALS - COUNTY JUDGES. (a)
8080 The department shall issue without charge specialty license plates
8181 for current county judges of this state. The license plates shall
8282 bear the words "County Judge."
8383 (b) A person may be issued two sets of license plates under
8484 this section.
8585 (c) The license plates remain valid until December 31 of
8686 each year.
8787 (c) In this section, "county judge" means the judge of the
8888 county court established under Section 15, Article V, of the Texas
8989 Constitution.
9090 SECTION 7. Chapter 504, Transportation Code, is amended by
9191 adding Section 504.403B to read as follows:
9292 Section 504.403B. COUNTY OFFICIALS - SHERIFFS. (a) The
9393 department shall issue without charge specialty license plates for
9494 current county sheriffs of this state. The license plates shall
9595 bear the words "County Sheriff."
9696 (b) A person may be issued one set of license plates under
9797 this section.
9898 (c) The license plates remain valid until December 31 of
9999 each year.
100100 SECTION 7. Chapter 504, Transportation Code, is amended by
101101 adding Section 504.403B to read as follows:
102102 Section 504.403C. COUNTY OFFICIALS - CONSTABLES. (a) The
103103 department shall issue without charge specialty license plates for
104104 current county constables of this state. The license plates shall
105105 bear the words "County Constable."
106106 (b) A person may be issued one set of license plates under
107107 this section.
108108 (c) The license plates remain valid until December 31 of
109109 each year.
110110 SECTION 8. Section 504.405 and Section 504.406,
111111 Transportation Code, are repealed.
112112 SECTION 9. This Act takes effect January 1, 2010.
