4	4	A BILL TO BE ENTITLED
5	5	AN ACT
6	6	relating to certain license plates issued by the Texas Department
7	7	of Transportation.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 504.401(a) is amended to read as
10	10	follows:
11	11	Sec. 504.401A. STATE OFFICIALS - EXECUTIVE AND LEGISLATIVE
12	12	BRANCHES. (a) The department shall issue without charge specialty
13	13	license plates to a state official. The license plates must include
14	14	the words "State Official."
15	15	(b) A state official may be issued four three sets of
16	16	license plates under this section;
17	17	(c) The license plates remain valid until December 31 of
18	18	each year.
19	19	(d) In this section, "state official" means:
20	20	(1) a member of the legislature;
21	21	(2) the governor;
22	22	(3) the lieutenant governor;
23	23	(4) a justice of the supreme court;
24	24	(5) a judge of the court of criminal appeals;
25	25	(6) the attorney general;
26	26	(5) (7) the Commissioner of the General Land Office;
27	27	(6) (8) the comptroller;
28	28	(7) (9) a member of the Railroad Commission of Texas;
29	29	(8) (10) the commissioner of agriculture;
30	30	(9) (11) the secretary of state; or
31	31	(10) (12) a member of the State Board of Education.
32	32	SECTION 2. Chapter 504 of the Transportation Code is
33	33	amended by adding Section 504.401B to read as follows:
34	34	Sec.504.401B - STATE OFFICIALS - JUDICIAL BRANCH. (a) The
35	35	department shall issue without charge specialty license plates for
36	36	a current state judge. The license plates must include the words
37	37	"State Judge."
38	38	(b) A person may be issued three sets of plates under this
39	39	section.
40	40	(c) The license plates remain valid until December 31 of
41	41	each year.
42	42	(d) In this section, a "state judge" includes:
43	43	(1) a justice of the supreme court;
44	44	(2) a judge of the court of criminal appeals;
45	45	(3) a judge of a court of appeals;
46	46	(4) a district court judge;
47	47	(5) a presiding judge of an administrative judicial
48	48	district; or
49	49	(6) a judge of a statutory county court.
50	50	SECTION 3. Section 504.402, Transportation Code, is amended
51	51	to read as follows:
52	52	Sec.504.402A. FEDERAL OFFICIALS - LEGISLATIVE BRANCH. (a)
53	53	The department shall issue without charge specialty license plates
54	54	for members of congress. License plates issued under this section
55	55	must include the words "U.S. Congress."
56	56	(b) A person may be issued four three sets of license plates
57	57	under this section.
58	58	(c) The license plates remain valid until December 31 of
59	59	each year.
60	60	SECTION 4. Chapter 504 of the Transportation Code is
61	61	amended by adding Section 504.402B to read as follows:
62	62	Sec.504.402B - FEDERAL OFFICIALS - JUDICIAL BRANCH. (a) The
63	63	department shall issue without charge specialty license plates for
64	64	a current federal judge. The license plates must include the words
65	65	"U.S. Judge."
66	66	(b) A person may be issued three sets of plates under this
67	67	section.
68	68	(c) The license plates remain valid until December 31 of
69	69	each year.
70	70	(d) In this section, a "federal judge" includes:
71	71	(1) a justice of the United States Supreme Court whose
72	72	primary residence is in Texas;
73	73	(2) a judge of the Fifth Circuit Court of Appeals; or
74	74	(3) a judge of a United States district.
75	75	SECTION 5. Section 504.403 and Section 504.404,
76	76	Transportation Code, are repealed.
77	77	SECTION 6. Chapter 504, Transportation Code, is amended by
78	78	adding Section 504.403A to read as follows:
79	79	Section 504.403A. COUNTY OFFICIALS - COUNTY JUDGES. (a)
80	80	The department shall issue without charge specialty license plates
81	81	for current county judges of this state. The license plates shall
82	82	bear the words "County Judge."
83	83	(b) A person may be issued two sets of license plates under
84	84	this section.
85	85	(c) The license plates remain valid until December 31 of
86	86	each year.
87	87	(c) In this section, "county judge" means the judge of the
88	88	county court established under Section 15, Article V, of the Texas
89	89	Constitution.
90	90	SECTION 7. Chapter 504, Transportation Code, is amended by
91	91	adding Section 504.403B to read as follows:
92	92	Section 504.403B. COUNTY OFFICIALS - SHERIFFS. (a) The
93	93	department shall issue without charge specialty license plates for
94	94	current county sheriffs of this state. The license plates shall
95	95	bear the words "County Sheriff."
96	96	(b) A person may be issued one set of license plates under
97	97	this section.
98	98	(c) The license plates remain valid until December 31 of
99	99	each year.
100	100	SECTION 7. Chapter 504, Transportation Code, is amended by
101	101	adding Section 504.403B to read as follows:
102	102	Section 504.403C. COUNTY OFFICIALS - CONSTABLES. (a) The
103	103	department shall issue without charge specialty license plates for
104	104	current county constables of this state. The license plates shall
105	105	bear the words "County Constable."
106	106	(b) A person may be issued one set of license plates under
107	107	this section.
108	108	(c) The license plates remain valid until December 31 of
109	109	each year.
110	110	SECTION 8. Section 504.405 and Section 504.406,
111	111	Transportation Code, are repealed.
112	112	SECTION 9. This Act takes effect January 1, 2010.
