66 AN ACT
77 relating to the organization, duties, and functions of the Texas
88 Veterans Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 434.014(a), Government Code, is amended
1111 to read as follows:
1212 (a) The executive director or the executive director's
1313 designee shall develop a career ladder program. The program must
1414 require that openings in all positions except entry level positions
1515 be posted within the commission concurrently with any [for at least
1616 10 days before they are posted for the] public posting.
1717 SECTION 2. Subchapter A, Chapter 434, Government Code, is
1818 amended by adding Section 434.0161 to read as follows:
1919 Sec. 434.0161. USE OF FUNDS TO SUPPORT OUTREACH AND
2020 TRAINING. The commission may use appropriated funds to purchase,
2121 for use at outreach and training functions:
2222 (1) promotional items that include the agency's name
2323 and contact information to be distributed to veterans; and
2424 (2) food and beverages.
2525 SECTION 3. Section 2167.001(b), Government Code, is amended
2626 to read as follows:
2727 (b) This chapter does not apply to:
2828 (1) radio antenna space;
2929 (2) residential space for a Texas Department of Mental
3030 Health and Mental Retardation program;
3131 (3) residential space for a Texas Youth Commission
3232 program;
3333 (4) space to be used for less than one month for
3434 meetings, conferences, conventions, seminars, displays,
3535 examinations, auctions, or similar purposes;
3636 (5) district office space for members of the
3737 legislature;
3838 (6) space used by the Texas Workforce Commission;
3939 (7) residential property acquired by the Texas
4040 Department of Housing and Community Affairs or the Texas State
4141 Affordable Housing Corporation that is offered for sale or rental
4242 to individuals and families of low or very low income or families of
4343 moderate income; [or]
4444 (8) except as provided by Section 2167.007, classroom
4545 and instructional space for an institution of higher education; or
4646 (9) space leased by the Texas Veterans Commission to
4747 administer the veterans employment services program.
4848 SECTION 4. Section 2167.001(b), Government Code, as amended
4949 by this Act, applies only to a lease agreement entered into on or
5050 after the effective date of this Act. A lease agreement entered into
5151 before the effective date of this Act is governed by the law in
5252 effect at the time the lease agreement was entered into, and the
5353 former law is continued in effect for that purpose.
5454 SECTION 5. This Act takes effect September 1, 2009.
