| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 86.011, Election Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) This subsection applies only to an election held in a |
|---|
| 13 | 13 | | county with a population of 20,000 or more in which a federal office |
|---|
| 14 | 14 | | appears on the ballot. The early voting clerk shall make the unique |
|---|
| 15 | 15 | | identification number described by Section 86.013(h) available on |
|---|
| 16 | 16 | | the county's website and indicate whether the return of the |
|---|
| 17 | 17 | | official carrier envelope associated with the number is timely. |

| 18 | 18 | | SECTION 2. Section 86.013, Election Code, is amended by |
|---|
| 19 | 19 | | adding Subsection (h) to read as follows: |
|---|
| 20 | 20 | | (h) This subsection applies only to an election held in a |
|---|
| 21 | 21 | | county with a population of 20,000 or more in which a federal office |
|---|
| 22 | 22 | | appears on the ballot. The secretary of state by rule shall require |
|---|
| 23 | 23 | | that a detachable receipt be attached to the official carrier |
|---|
| 24 | 24 | | envelope and a unique identification number be printed on the |
|---|
| 25 | 25 | | receipt and the reverse side of the envelope. |

| 26 | 26 | | SECTION 3. Sections 86.011(e) and 86.013(h), Election Code, |
|---|
| 27 | 27 | | as added by this Act, apply only to an election ordered on or after |
|---|
| 28 | 28 | | September 1, 2009. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect September 1, 2009. |
