1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1451.114, Insurance Code, is amended to
1212 read as follows:
1313 Sec. 1451.114. SELECTION OF LICENSED PROFESSIONAL
1414 COUNSELOR. [(a)] An insured may select a licensed professional
1515 counselor to provide the services scheduled in the health insurance
1616 policy that are within the scope of the counselor's license.
1717 [(b) The health insurance policy may require that services
1818 of a licensed professional counselor must be recommended by a
1919 physician.]
2020 SECTION 2. Section 1451.116, Insurance Code, is amended to
2121 read as follows:
2222 Sec. 1451.116. SELECTION OF MARRIAGE AND FAMILY THERAPIST.
2323 [(a)] An insured may select a marriage and family therapist to
2424 provide the services scheduled in the health insurance policy that
2525 are within the scope of the therapist's license.
2626 [(b) The health insurance policy may require that services
2727 of a marriage and family therapist must be recommended by a
2828 physician.]
2929 SECTION 3. This Act applies only to an insurance policy or
3030 contract or evidence of coverage that is delivered, issued for
3131 delivery, or renewed on or after January 1, 2010. An insurance
3232 policy or contract or evidence of coverage delivered, issued for
3333 delivery, or renewed before January 1, 2010, is governed by the law
3434 as it existed immediately before the effective date of this Act, and
3535 that law is continued in effect for that purpose.
3636 SECTION 4. This Act takes effect September 1, 2009.
