| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 51.013, Transportation Code, is amended | |
| 13 | 13 | to read as follows: | |
| 14 | 14 | Sec. 51.013. DREDGED MATERIAL DISPOSAL. (a) The | |
| 15 | 15 | department shall condemn land for disposal of dredged material for | |
| 16 | 16 | the Laguna Madre section of the Gulf Coast Intracoastal Waterway | |
| 17 | 17 | only in accordance with the Draft Laguna Madre GIWW Dredged | |
| 18 | 18 | Material Management Plan prepared by the Army Corps of Engineers | |
| 19 | 19 | and the Interagency Coordination Team dated October 11, 2002. | |
| 20 | 20 | (b) On request by a political subdivision, the commission | |
| 21 | 21 | may enter into a contract with a political subdivision to dispose of | |
| 22 | 22 | dredged material from the Highland Bayou Diversionary Canal on | |
| 23 | 23 | Placement Area 58A of the Gulf Coast Intracoastal Waterway. | |
| 24 | 24 | (c) The commission may not charge a fee for disposal under | |
| 25 | 25 | Subsection (b). | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2009. |
