44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of the Texas Gaming Commission to
77 regulate games of chance or other gaming activities at specific
88 locations including dog or horse tracks, destination resort
99 casinos, or on Indian tribal lands.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle E, Title 4, Government Code, is amended
1212 by adding Chapter 470 to read as follows:
1313 CHAPTER 470. TEXAS GAMING COMMISSION.
1414 Sec. 470.001. COMPOSITION OF COMMISSION. The Texas Gaming
1515 Commission consists of nine members appointed by the Governor who
1616 each serve a term of two years. Five members serve terms that
1717 expire February 15 of each odd numbered year and four members serve
1818 terms that expire February 15 of each even numbered year. The
1919 governor shall designate one member a presiding officer of the
2020 commission.
2121 Sec. 470.002. EXECUTIVE DIRECTOR; STAFF. The commission may
2222 employ an executive director and other staff as necessary to carry
2323 out its duties under this chapter.
2424 Sec. 470.003. POWERS OF COMMISSION. The commission shall
2525 provide for the licensing of persons to conduct games of chance or
2626 any other gaming activity, including slot machines, at a specified
2727 location, including a dog or horse race track, a destination resort
2828 casino, Indian tribal land, or any other location determined
2929 appropriate by the commission.
3030 Sec. 470.004. LOCAL OPTION ELECTION. The commission may
3131 condition a license under this chapter for a location on the
3232 approval of the gaming activity at an election held in a defined
3333 area that contains the location.
3434 Sec. 470.005. DEDICATION OF REVENUES. From the revenue the
3535 state receives from the operation of a location licensed under this
3636 chapter:
3737 (1) one-quarter is dedicated to public education;
3838 (2) one-quarter is dedicated to transportation; and
3939 (3) the remainder shall be deposited to the credit of
4040 the general revenue fund.
4141 Sec. 470.006. RULES. The commission may adopt rules as
4242 necessary to implement this chapter.
4343 SECTION 2. This Act takes effect January 1, 2009, but only
4444 if the constitutional amendment adding Section 47a, Article III,
4545 Texas Constitution, authorizing and regulating games of chance or
4646 other gaming activities at specific locations is approved by the
4747 voters. If that amendment is not approved by the voters, this Act
4848 has no effect.
