7 | 7 | | regulate games of chance or other gaming activities at specific |

8 | 8 | | locations including dog or horse tracks, destination resort |
---|
9 | 9 | | casinos, or on Indian tribal lands. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle E, Title 4, Government Code, is amended |
---|
12 | 12 | | by adding Chapter 470 to read as follows: |
---|
13 | 13 | | CHAPTER 470. TEXAS GAMING COMMISSION. |
---|
14 | 14 | | Sec. 470.001. COMPOSITION OF COMMISSION. The Texas Gaming |
---|
15 | 15 | | Commission consists of nine members appointed by the Governor who |
---|
16 | 16 | | each serve a term of two years. Five members serve terms that |
---|
17 | 17 | | expire February 15 of each odd numbered year and four members serve |
---|
18 | 18 | | terms that expire February 15 of each even numbered year. The |
---|
19 | 19 | | governor shall designate one member a presiding officer of the |
---|
20 | 20 | | commission. |
---|
21 | 21 | | Sec. 470.002. EXECUTIVE DIRECTOR; STAFF. The commission may |
---|
22 | 22 | | employ an executive director and other staff as necessary to carry |
---|
23 | 23 | | out its duties under this chapter. |
---|
24 | 24 | | Sec. 470.003. POWERS OF COMMISSION. The commission shall |
---|
25 | 25 | | provide for the licensing of persons to conduct games of chance or |
---|
26 | 26 | | any other gaming activity, including slot machines, at a specified |
---|
27 | 27 | | location, including a dog or horse race track, a destination resort |
---|
28 | 28 | | casino, Indian tribal land, or any other location determined |
---|
29 | 29 | | appropriate by the commission. |
---|
30 | 30 | | Sec. 470.004. LOCAL OPTION ELECTION. The commission may |
---|
31 | 31 | | condition a license under this chapter for a location on the |
---|
32 | 32 | | approval of the gaming activity at an election held in a defined |
---|
33 | 33 | | area that contains the location. |
---|
34 | 34 | | Sec. 470.005. DEDICATION OF REVENUES. From the revenue the |
---|
35 | 35 | | state receives from the operation of a location licensed under this |
---|
36 | 36 | | chapter: |
---|
37 | 37 | | (1) one-quarter is dedicated to public education; |
---|
38 | 38 | | (2) one-quarter is dedicated to transportation; and |
---|
39 | 39 | | (3) the remainder shall be deposited to the credit of |
---|
40 | 40 | | the general revenue fund. |
---|
41 | 41 | | Sec. 470.006. RULES. The commission may adopt rules as |
---|
42 | 42 | | necessary to implement this chapter. |
---|
43 | 43 | | SECTION 2. This Act takes effect January 1, 2009, but only |
---|
44 | 44 | | if the constitutional amendment adding Section 47a, Article III, |
---|
45 | 45 | | Texas Constitution, authorizing and regulating games of chance or |
---|
46 | 46 | | other gaming activities at specific locations is approved by the |
---|
47 | 47 | | voters. If that amendment is not approved by the voters, this Act |
---|
48 | 48 | | has no effect. |
