| 7 | 7 | | relating to eligibility of certain professional librarian faculty |

| 9 | 9 | | in the group benefits program for state employees. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 1551.1021, Insurance Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) Notwithstanding Subsections (a)(2) and (3), an |
|---|
| 14 | 14 | | adjunct faculty member at a public institution of higher education |
|---|
| 15 | 15 | | who is a professional librarian is eligible to participate in the |
|---|
| 16 | 16 | | group benefits program as an employee if the faculty member |
|---|
| 17 | 17 | | receives compensation for services rendered to a public institution |
|---|
| 18 | 18 | | of higher education as an adjunct faculty member. |
|---|
| 19 | 19 | | SECTION 2. The board of trustees of the Employees |
|---|
| 20 | 20 | | Retirement System of Texas shall include coverage under Section |
|---|
| 21 | 21 | | 1551.1021, Insurance Code, as amended by this Act, in an insurance |
|---|
| 22 | 22 | | policy or contract or evidence of coverage delivered, issued for |
|---|
| 23 | 23 | | delivery, or renewed on or after January 1, 2010. The board of |
|---|
| 24 | 24 | | trustees may include coverage under Section 1551.1021, Insurance |
|---|
| 25 | 25 | | Code, as amended by this Act, in an insurance policy or contract or |
|---|
| 26 | 26 | | an evidence of coverage delivered, issued for delivery, or renewed |
|---|
| 27 | 27 | | before January 1, 2010, if the board of trustees determines that the |
|---|
| 28 | 28 | | coverage may reasonably be included. |
|---|
| 29 | 29 | | SECTION 3. Except as otherwise provided by this Act, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2009. |
