88 relating to the investment authority of the Teacher Retirement
99 System of Texas and the Employees Retirement System of Texas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 815.301, Government Code, is amended by
1212 adding Subsections (g) and (h) to read as follows:
1313 (g) In awarding contracts to private professional
1414 investment managers under Subsection (c) or otherwise acquiring
1515 private financial services, the board of trustees shall make a good
1616 faith effort to award contracts to or acquire services from
1717 qualified emerging fund managers.
1818 (h) For purposes of Subsection (g):
1919 (1) "Emerging fund manager" means a private
2020 professional investment manager that manages assets of not more
2121 than $2 billion.
2222 (2) "Private financial services" includes pension
2323 fund management, consulting, investment advising, brokerage
2424 services, hedge fund management, private equity fund management,
2525 and real estate investment.
2626 SECTION 2. Section 825.301, Government Code, is amended by
2727 adding Subsections (f) and (g) to read as follows:
2828 (f) In awarding contracts to private professional
2929 investment managers under Subsection (a-2) or otherwise acquiring
3030 private financial services, the board of trustees shall make a good
3131 faith effort to award contracts to or acquire services from
3232 qualified emerging fund managers.
3333 (g) For purposes of Subsection (f):
3434 (1) "Emerging fund manager" means a private
3535 professional investment manager that manages assets of not more
3636 than $2 billion.
3737 (2) "Private financial services" includes pension
3838 fund management, consulting, investment advising, brokerage
3939 services, hedge fund management, private equity fund management,
4040 and real estate investment.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
