55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to including certain veterans service organizations as
88 small businesses for the purpose of state contracting.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2155.505(a), Government Code, is amended
1111 by amending Subdivision (2) and adding Subdivision (3) to read as
1212 follows:
1313 (2) "Small business" means a small business concern as
1414 defined by regulations of the United States Small Business
1515 Administration in 13 C.F.R. Section 121.201 or a veterans service
1616 agency.
1717 (3) "Veterans service agency" means a community-based
1818 organization that:
1919 (A) is exempt from taxation under Section 501(a),
2020 Internal Revenue Code of 1986, as an organization described in
2121 Section 501(c)(3) of that code; and
2222 (B) has as its principal purpose to provide
2323 housing, substance abuse treatment, case management services, and
2424 employment training to low-income veterans, disabled veterans, and
2525 homeless veterans and their families.
2626 SECTION 2. Section 2155.505(a), Government Code, as amended
2727 by this Act, applies only to a contract for the procurement of goods
2828 and services for which the solicitation of bids or proposals,
2929 request for proposals, or similar required notification as to the
3030 goods or services is published on or after September 1, 2009. A
3131 contract for the procurement of goods and services for which the
3232 solicitation of bids or proposals, request for proposals, or
3333 similar required notification as to the goods or services is
3434 published before September 1, 2009, is governed by the law in effect
3535 at the time the solicitation, request, or notification is
3636 published, and that law is continued in effect for that purpose.
3737 SECTION 3. This Act takes effect September 1, 2009.
