55 relating to eligibility requirements for the tuition equalization

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 61.2251(b), (c), and (e), Education
99 Code, as added by Chapter 1230 (H.B. 1172), Acts of the 79th
1010 Legislature, Regular Session, 2005, are amended to read as follows:
1111 (b) To be eligible for a tuition equalization grant in the
1212 first academic year in which the person receives the grant, a person
1313 must:
1414 (1) be a Texas resident as defined by the coordinating
1515 board and meet, at a minimum, the resident requirements defined by
1616 law for Texas resident tuition in fully state-supported
1717 institutions of higher education;
1818 (2) be enrolled in at least three-fourths of [for] a
1919 full course load conforming to an individual degree plan in an
2020 approved college or university;
2121 (3) be required to pay more tuition than is required at
2222 a public college or university and be charged no less than the
2323 regular tuition required of all students enrolled at the
2424 institution;
2525 (4) establish financial need in accordance with
2626 procedures and regulations of the coordinating board;
2727 (5) not be a recipient of any form of athletic
2828 scholarship; [and]
2929 (6) make satisfactory academic progress toward a
3030 degree or certificate as determined by the institution at which the
3131 person is enrolled; and
3232 (7) have complied with other requirements adopted by
3333 the coordinating board under this subchapter.
3434 (c) After qualifying for a tuition equalization grant under
3535 Subsection (b), a person may receive a tuition equalization grant
3636 in a subsequent academic year in which the person is enrolled at an
3737 approved institution only if the person:
3838 (1) meets the requirements of Subsection (b);
3939 (2) completed at least:
4040 (A) 24 semester credit hours in the person's most
4141 recent full academic year, if the person is enrolled in an
4242 undergraduate degree or certificate program; or
4343 (B) 18 semester credit hours in the person's most
4444 recent full academic year, if the person is enrolled in a graduate
4545 or professional degree program; and
4646 (3) has earned an overall grade point average of at
4747 least 2.5 on a four-point scale or the equivalent on coursework
4848 previously attempted at public or private institutions of higher
4949 education.
5050 (e) The coordinating board shall adopt rules to allow a
5151 person who is otherwise eligible to receive a tuition equalization
5252 grant, in the event of a hardship or for other good cause shown, to
5353 receive a tuition equalization grant if the person does not:
5454 (1) make satisfactory academic progress as required
5555 under Subsection (b)(6);
5656 (2) complete the semester credit hours required by
5757 Subsection (c)(2);
5858 (3) [(2)] maintain the grade point average required by
5959 Subsection (c)(3); or
6060 (4) [(3)] complete the person's certificate or degree
6161 program within the period prescribed by Subsection (d).
6262 SECTION 2. (a) The changes in law made by this Act to
6363 Section 61.2251, Education Code, apply beginning with tuition
6464 equalization grants awarded for the 2009-2010 academic year. For
6565 that purpose, a person's eligibility for a grant under Section
6666 61.2251(c), Education Code, as amended by this Act, for the
6767 2009-2010 academic year shall be based on the person's satisfaction
6868 of the requirements of Section 61.2251(c), as amended, in the
6969 2008-2009 academic year, without regard to whether the person
7070 satisfied the former requirements of Section 61.2251(c) or received
7171 a grant under Subchapter F, Chapter 61, Education Code, in that
7272 academic year.
7373 (b) A tuition equalization grant awarded for an academic
7474 year before the 2009-2010 academic year is covered by the law in
7575 effect when the grant was awarded, and that law is continued in
7676 effect for that purpose.
7777 SECTION 3. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2009.
