55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the offense of unlawful transport or
88 concealment of an illegal alien.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 20A, Penal Code, is amended by adding
1111 Section 20A.03 to read as follows:
1212 Sec. 20A.03. UNLAWFUL TRANSPORT OR CONCEALMENT OF ILLEGAL
1313 ALIEN. (a) In this section, "illegal alien" means a person who:
1414 (1) is not a citizen or national of the United States;
1515 and
1616 (2) is unlawfully present in the United States
1717 according to the terms of 8 U.S.C. Section 1101 et seq.
1818 (b) A person commits an offense if the person, with
1919 recklessness as to another person's status as an illegal alien:
2020 (1) transports the illegal alien in furtherance of the
2121 alien's unlawful presence in the United States; or
2222 (2) conceals the illegal alien from detection by
2323 local, state, or federal law enforcement authorities.
2424 (c) An offense under this section is a state jail felony.
2525 (d) If conduct constituting an offense under this section
2626 also constitutes an offense under another section of this code, the
2727 actor may be prosecuted under either section.
2828 (e) It is an exception to the application of Subsection
2929 (b)(1) that the offense occurred in the provision of:
3030 (1) a state or local public benefit described in 8
3131 U.S.C. Section 1621(b); or
3232 (2) regulated public health services by a private
3333 charity using private funds.
3434 SECTION 2. This Act takes effect September 1, 2009.
