7 | 7 | | relating to the creation of the offense of unlawful transport or |
---|
8 | 8 | | concealment of an illegal alien. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 20A, Penal Code, is amended by adding |
---|
11 | 11 | | Section 20A.03 to read as follows: |
---|
12 | 12 | | Sec. 20A.03. UNLAWFUL TRANSPORT OR CONCEALMENT OF ILLEGAL |
---|
13 | 13 | | ALIEN. (a) In this section, "illegal alien" means a person who: |
---|
14 | 14 | | (1) is not a citizen or national of the United States; |
---|
15 | 15 | | and |
---|
16 | 16 | | (2) is unlawfully present in the United States |
---|
17 | 17 | | according to the terms of 8 U.S.C. Section 1101 et seq. |
---|
18 | 18 | | (b) A person commits an offense if the person, with |
---|
19 | 19 | | recklessness as to another person's status as an illegal alien: |
---|
20 | 20 | | (1) transports the illegal alien in furtherance of the |
---|
21 | 21 | | alien's unlawful presence in the United States; or |
---|
22 | 22 | | (2) conceals the illegal alien from detection by |
---|
23 | 23 | | local, state, or federal law enforcement authorities. |
---|
24 | 24 | | (c) An offense under this section is a state jail felony. |
---|
25 | 25 | | (d) If conduct constituting an offense under this section |
---|
26 | 26 | | also constitutes an offense under another section of this code, the |
---|
27 | 27 | | actor may be prosecuted under either section. |
---|
28 | 28 | | (e) It is an exception to the application of Subsection |
---|
29 | 29 | | (b)(1) that the offense occurred in the provision of: |
---|
30 | 30 | | (1) a state or local public benefit described in 8 |
---|
31 | 31 | | U.S.C. Section 1621(b); or |
---|
32 | 32 | | (2) regulated public health services by a private |
---|
33 | 33 | | charity using private funds. |
---|
34 | 34 | | SECTION 2. This Act takes effect September 1, 2009. |
