| 8 | 8 | SECTION 1. Sec. 403.0305, Government Code, is amended to | |
| 9 | 9 | read as follows: | |
| 10 | 10 | Sec. 403.0305. LEGAL FEES [APPROVAL BY COMPTROLLER]. A | |
| 11 | 11 | public agency as defined under Section 30.003(3), Water Code, is | |
| 12 | 12 | free to contract for legal fees on any basis allowed pursuant to | |
| 13 | 13 | Rule 1.04, State Bar Rules of Professional Conduct [may not enter | |
| 14 | 14 | into a contract as provided by Subchapter C, Chapter 2254, without | |
| 15 | 15 | review and approval by the comptroller]. | |
| 16 | 16 | SECTION 2. This Act takes effect immediately if it receives | |
| 17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
| 18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
| 19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
| 20 | 20 | Act takes effect September 1, 2009. |
