55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to maximization of the amount of federal funding obtained
88 by school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. FEDERAL FUNDING MAXIMIZATION STUDY. The
1111 comptroller of public accounts shall conduct a comprehensive study
1212 of federal funding sources, including federal funding provided
1313 through the Medicaid program and other health and human services
1414 programs, to determine the extent to which school districts in this
1515 state are failing to claim all available federal funds for services
1616 provided by school districts or services that could be provided by
1717 school districts if the federal funds were claimed.
1818 SECTION 2. SCHOOL DISTRICT TRAINING. Based on the results
1919 of the study conducted under Section 1 of this Act, the Texas
2020 Education Agency shall develop and implement an initiative under
2121 which the agency provides detailed training to school districts as
2222 necessary to improve the ability of districts to claim all
2323 available federal funds. The training must specifically address
2424 the procedures for filing prompt and accurate claims for available
2525 federal funds.
2626 SECTION 3. REPORT TO LEGISLATURE. Not later than January 1,
2727 2011, the comptroller and the Texas Education Agency shall submit a
2828 joint report to the legislature that addresses the results of the
2929 study conducted under Section 1 of this Act and describes the
3030 training provided under Section 2 of this Act.
3131 SECTION 4. EFFECTIVE DATE. This Act takes effect
3232 immediately if it receives a vote of two-thirds of all the members
3333 elected to each house, as provided by Section 39, Article III, Texas
3434 Constitution. If this Act does not receive the vote necessary for
3535 immediate effect, this Act takes effect September 1, 2009.
