77 relating to reporting requirements for health occupation
88 regulatory agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 3, Occupations Code, is
1111 amended by adding Chapter 114 to read as follows:
1212 CHAPTER 114. REPORTING REQUIREMENTS APPLICABLE TO MULTIPLE HEALTH
1313 OCCUPATION REGULATORY AGENCIES
1414 Sec. 114.001. DEFINITIONS. In this chapter:
1515 (1) "Health care practitioner" means an individual
1616 issued a license, certificate, registration, title, permit, or
1717 other authorization to engage in a health care profession.
1818 (2) "Health occupation regulatory agency" means a
1919 department, commission, board, office, authority, or other agency
2020 of the state that regulates a health care practitioner under this
2121 title.
2222 Sec. 114.002. ANNUAL REPORT TO LEGISLATURE. (a) Not later
2323 than February 1 of each year, each health occupation regulatory
2424 agency shall file a report with the chairs of the house and senate
2525 committees with primary oversight over the agency that includes the
2626 following:
2727 (1) the number of persons regulated by the agency;
2828 (2) the number of persons who became subject to
2929 regulation by the agency in the previous year;
3030 (3) the number of persons regulated by the agency by
3131 county;
3232 (4) a description of any complaints reported to the
3333 agency or a description of the complaint categories used by the
3434 agency and the number of complaints in each category;
3535 (5) the number of complaints investigated by the
3636 agency and a description of the final resolution of the complaints;
3737 (6) the amount of fees collected by the agency each
3838 year;
3939 (7) the expenses of the agency; and
4040 (8) any unfunded needs of the agency.
4141 (b) The Health Professions Council shall adopt a standard
4242 format that must be used by health occupation regulatory agencies
4343 to report the information required under Subsection (a).
4444 SECTION 2. Not later than January 1, 2010, the Health
4545 Professions Council shall adopt the standard reporting format
4646 required under Subsection (b), Section 114.002, Occupations Code,
4747 as added by this Act.
4848 SECTION 3. This Act takes effect September 1, 2009.
