9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle A, Title 3, Occupations Code, is |
---|
11 | 11 | | amended by adding Chapter 114 to read as follows: |
---|
12 | 12 | | CHAPTER 114. REPORTING REQUIREMENTS APPLICABLE TO MULTIPLE HEALTH |
---|
13 | 13 | | OCCUPATION REGULATORY AGENCIES |
---|
14 | 14 | | Sec. 114.001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Health care practitioner" means an individual |
---|
16 | 16 | | issued a license, certificate, registration, title, permit, or |
---|
17 | 17 | | other authorization to engage in a health care profession. |
---|
18 | 18 | | (2) "Health occupation regulatory agency" means a |
---|
19 | 19 | | department, commission, board, office, authority, or other agency |
---|
20 | 20 | | of the state that regulates a health care practitioner under this |
---|
21 | 21 | | title. |
---|
22 | 22 | | Sec. 114.002. ANNUAL REPORT TO LEGISLATURE. (a) Not later |
---|
23 | 23 | | than February 1 of each year, each health occupation regulatory |
---|
24 | 24 | | agency shall file a report with the chairs of the house and senate |
---|
25 | 25 | | committees with primary oversight over the agency that includes the |
---|
26 | 26 | | following: |
---|
27 | 27 | | (1) the number of persons regulated by the agency; |
---|
28 | 28 | | (2) the number of persons who became subject to |
---|
29 | 29 | | regulation by the agency in the previous year; |
---|
30 | 30 | | (3) the number of persons regulated by the agency by |
---|
31 | 31 | | county; |
---|
32 | 32 | | (4) a description of any complaints reported to the |
---|
33 | 33 | | agency or a description of the complaint categories used by the |
---|
34 | 34 | | agency and the number of complaints in each category; |
---|
35 | 35 | | (5) the number of complaints investigated by the |
---|
36 | 36 | | agency and a description of the final resolution of the complaints; |
---|
37 | 37 | | (6) the amount of fees collected by the agency each |
---|
38 | 38 | | year; |
---|
39 | 39 | | (7) the expenses of the agency; and |
---|
40 | 40 | | (8) any unfunded needs of the agency. |
---|
41 | 41 | | (b) The Health Professions Council shall adopt a standard |
---|
42 | 42 | | format that must be used by health occupation regulatory agencies |
---|
43 | 43 | | to report the information required under Subsection (a). |
---|
44 | 44 | | SECTION 2. Not later than January 1, 2010, the Health |
---|
45 | 45 | | Professions Council shall adopt the standard reporting format |
---|
46 | 46 | | required under Subsection (b), Section 114.002, Occupations Code, |
---|
47 | 47 | | as added by this Act. |
---|
48 | 48 | | SECTION 3. This Act takes effect September 1, 2009. |
