| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter B, Chapter 22, |

| 11 | 11 | | Business Organizations Code, is amended to read as follows: |

| 12 | 12 | | SUBCHAPTER B. PURPOSES, [AND] POWERS, AND DUTIES |

| 13 | 13 | | SECTION 2. Subchapter B, Chapter 22, Business Organizations |

| 14 | 14 | | Code, is amended by adding Section 22.058 to read as follows: |

| 15 | 15 | | Sec. 22.058. CONTRACTS FOR SERVICES BY CERTAIN NONPROFIT |
|---|
| 16 | 16 | | CORPORATIONS. (a) This section applies only to a nonprofit |
|---|
| 17 | 17 | | corporation that: |
|---|
| 18 | 18 | | (1) is described by Section 501(c)(3), Internal |
|---|
| 19 | 19 | | Revenue Code of 1986; and |
|---|
| 20 | 20 | | (2) has total annual gross revenues of $50 million or |
|---|
| 21 | 21 | | more, according to the corporation's most recent financial |
|---|
| 22 | 22 | | statement. |
|---|
| 23 | 23 | | (b) A nonprofit corporation to which this section applies |
|---|
| 24 | 24 | | must obtain services in the manner provided for the purchase of |
|---|
| 25 | 25 | | services by a state agency using the request for proposals method |
|---|
| 26 | 26 | | under Subtitle D, Title 10, Government Code. |
|---|
| 27 | 27 | | SECTION 3. Section 22.058, Business Organizations Code, as |
|---|
| 28 | 28 | | added by this Act, applies only to a contract that is entered into |
|---|
| 29 | 29 | | on or after the effective date of this Act. A contract entered into |
|---|
| 30 | 30 | | before the effective date of this Act is governed by the law in |
|---|
| 31 | 31 | | effect on the date the contract was entered into, and the former law |
|---|
| 32 | 32 | | is continued in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2009. |
