88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 371, Transportation Code, as added by
1010 Chapters 103 (H.B. 570) and 258 (S.B. 11), Acts of the 80th
1111 Legislature, Regular Session, 2007, is reenacted, redesignated as
1212 Chapter 372, Transportation Code, and amended to read as follows:
1313 CHAPTER 372 [371]. PROVISIONS APPLICABLE TO MORE THAN ONE TYPE OF
1414 TOLL PROJECT
1515 SUBCHAPTER A. GENERAL PROVISIONS
1616 Sec. 372.001 [371.001]. DEFINITIONS. In this chapter:
1717 (1) "Toll project" means a toll project described by
1818 Section 201.001(b), regardless of whether the toll project:
1919 (A) is a part of the state highway system; or
2020 (B) is subject to the jurisdiction of the
2121 department.
2222 (2) "Toll project entity" means an entity authorized
2323 by law to acquire, design, construct, finance, operate, and
2424 maintain a toll project, including:
2525 (A) the department under Chapter 227 or 228;
2626 (B) a regional tollway authority under Chapter
2727 366;
2828 (C) a regional mobility authority under Chapter
2929 370; or
3030 (D) a county under Chapter 284.
3131 SUBCHAPTER B. TOLL PROJECT OPERATION
3232 Sec. 372.051 [371.051]. USE OF MOTOR VEHICLE REGISTRATION
3333 OR LICENSE PLATE INFORMATION. (a) A toll project entity may not
3434 use motor vehicle registration or other information derived from a
3535 license plate on a vehicle using a toll project, including
3636 information obtained by the use of automated enforcement technology
3737 described by Section 228.058, for purposes other than those related
3838 to:
3939 (1) toll collection and toll collection enforcement;
4040 and
4141 (2) law enforcement purposes on request by a law
4242 enforcement agency[, subject to Section 228.058(d)].
4343 (b) If a toll project entity enters into an agreement with
4444 an entity in another state that involves the exchange of motor
4545 vehicle registration or license plate information for toll
4646 collection or toll collection enforcement purposes, the agreement
4747 must provide that the information may not be used for purposes other
4848 than those described in Subsection (a).
4949 Sec. 372.052 [371.001]. VEHICLES USED BY NONPROFIT
5050 DISASTER RELIEF ORGANIZATIONS. [(a) In this section:
5151 [(1) "Toll project" means a toll project described by
5252 Section 201.001(b), regardless of whether the toll project is:
5353 [(A) a part of the state highway system; or
5454 [(B) subject to the jurisdiction of the
5555 department.
5656 [(2) "Toll project entity" means an entity authorized
5757 by law to acquire, design, construct, finance, operate, and
5858 maintain a toll project, including:
5959 [(A) the department under Chapter 227 or 228;
6060 [(B) a regional tollway authority under Chapter
6161 366;
6262 [(C) a regional mobility authority under Chapter
6363 370; or
6464 [(D) a county under Chapter 284.
6565 [(b)] A toll project entity may not require a vehicle
6666 registered under Section 502.203 to pay a toll for the use of a toll
6767 project.
6868 Sec. 372.053. PROHIBITION AGAINST CHARGING VEHICLE LESSOR
6969 ADMINISTRATIVE FEE. A toll project entity may not charge a
7070 registered owner an administrative fee or cost for the nonpayment
7171 of a toll, including an administrative fee or cost under Section
7272 228.055, 284.0701, 366.178, or 370.177, if the registered owner is
7373 a lessor of the vehicle.
7474 SECTION 2. Section 372.053, Transportation Code, as added
7575 by this Act, applies only to the nonpayment of a toll that occurs on
7676 or after September 1, 2009.
7777 SECTION 3. This Act takes effect September 1, 2009.
