| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subtitle G, Title 7, Transportation Code, is |
|---|
| 14 | 14 | | amended by adding Chapter 664 to read as follows: |
|---|
| 15 | 15 | | CHAPTER 664. HIGH-PERFORMANCE MOTORCYCLE TRAINING |
|---|
| 16 | 16 | | Sec. 664.001. DEFINITIONS. In this chapter: |
|---|
| 17 | 17 | | (1) "Motorcycle" has the meaning assigned by Section |
|---|
| 18 | 18 | | 502.001 and includes a motorcycle equipped with a sidecar. |
|---|
| 19 | 19 | | (2) "Operator" has the meaning assigned by Section |
|---|
| 20 | 20 | | 541.001. |
|---|
| 21 | 21 | | (3) "Owner" has the meaning assigned by Section |
|---|
| 22 | 22 | | 541.001. |
|---|
| 23 | 23 | | (4) "High-performance motorcycle" means a motorcycle |
|---|
| 24 | 24 | | with a weight-to-power ratio of less than 3-1/2 pounds per |
|---|
| 25 | 25 | | horsepower, as determined by referencing the data contained on the |
|---|
| 26 | 26 | | manufacturer's certificate of origin for the motorcycle and |
|---|
| 27 | 27 | | dividing the motorcycle's dry shipping weight by its Society of |
|---|
| 28 | 28 | | Automotive Engineers net horsepower as shown on the manufacturer's |
|---|
| 29 | 29 | | certificate of origin. |
|---|
| 30 | 30 | | Sec. 664.002. (a) Each owner and operator of a |
|---|
| 31 | 31 | | high-performance motorcycle purchased on or after September 1, |
|---|
| 32 | 32 | | 2009, is required to take the training described by Chapter 662 |
|---|
| 33 | 33 | | within 180 days of the purchase of the motorcycle. Proof of |
|---|
| 34 | 34 | | successful completion of the training must be carried by the |
|---|
| 35 | 35 | | operator of a motorcycle purchased on or after September 1, 2009, |
|---|
| 36 | 36 | | and produced on demand of any peace officer of this state. |
|---|
| 37 | 37 | | (b) An offense under this section is a Class C misdemeanor. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2009. |
