99 relating to the use and safety of certain types of motorcycles and
1010 the establishment of a training requirement for the use of such
1111 motorcycles; providing a penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle G, Title 7, Transportation Code, is
1414 amended by adding Chapter 664 to read as follows:
1515 CHAPTER 664. HIGH-PERFORMANCE MOTORCYCLE TRAINING
1616 Sec. 664.001. DEFINITIONS. In this chapter:
1717 (1) "Motorcycle" has the meaning assigned by Section
1818 502.001 and includes a motorcycle equipped with a sidecar.
1919 (2) "Operator" has the meaning assigned by Section
2020 541.001.
2121 (3) "Owner" has the meaning assigned by Section
2222 541.001.
2323 (4) "High-performance motorcycle" means a motorcycle
2424 with a weight-to-power ratio of less than 3-1/2 pounds per
2525 horsepower, as determined by referencing the data contained on the
2626 manufacturer's certificate of origin for the motorcycle and
2727 dividing the motorcycle's dry shipping weight by its Society of
2828 Automotive Engineers net horsepower as shown on the manufacturer's
2929 certificate of origin.
3030 Sec. 664.002. (a) Each owner and operator of a
3131 high-performance motorcycle purchased on or after September 1,
3232 2009, is required to take the training described by Chapter 662
3333 within 180 days of the purchase of the motorcycle. Proof of
3434 successful completion of the training must be carried by the
3535 operator of a motorcycle purchased on or after September 1, 2009,
3636 and produced on demand of any peace officer of this state.
3737 (b) An offense under this section is a Class C misdemeanor.
3838 SECTION 2. This Act takes effect September 1, 2009.
