77 relating to the exercise of urban renewal powers by certain
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 374.902(b), Local Government Code, is
1111 amended to read as follows:
1212 (b) A county with a population of more than 60,000 and less
1313 than 300,000 and located along an international border or a county
1414 with a population of more than 1.3 million may exercise the powers
1515 provided for municipalities under this chapter with respect to
1616 areas of the county that are not within the corporate boundaries of
1717 a municipality or areas of the county located within the corporate
1818 boundaries of a municipality, if the municipality approves the
1919 county's participation in an urban renewal project through an
2020 interlocal agreement under Chapter 791, Government Code. The
2121 county may not exercise those powers until the commissioners court
2222 of the county adopts a resolution in the manner provided by Section
2323 374.011 for adoption of a resolution by a municipality. The
2424 resolution must be approved at an election held in the county in the
2525 manner provided for a municipal election under Section 374.011.
2626 The adoption of the resolution is not approved unless a majority of
2727 the voters who vote on the question in the entire county as well as
2828 in each municipality in the county approve the adoption of the
2929 resolution. In a municipality that is only partially located in the
3030 affected county, only voters who reside in the county may vote.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
