| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 410.252(a), Labor Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (a) A party may seek judicial review by filing suit not |
|---|
| 11 | 11 | | later than the 45th [40th] day after the date on which [the decision |
|---|
| 12 | 12 | | of the appeals panel was filed with] the division mailed the party |
|---|
| 13 | 13 | | the decision of the appeals panel. For purposes of this section, |
|---|
| 14 | 14 | | the mailing date is considered to be the fifth day after the date |
|---|
| 15 | 15 | | the decision of the appeals panel was filed with the division. |
|---|
| 16 | 16 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 17 | | to a judicial review proceeding initiated under Subchapter F or G, |
|---|
| 18 | 18 | | Chapter 410, Labor Code, on or after the effective date of this Act. |
|---|
| 19 | 19 | | A proceeding initiated before that date is governed by the law in |
|---|
| 20 | 20 | | effect on the date the proceeding was initiated, and the former law |
|---|
| 21 | 21 | | is continued in effect for that purpose. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2009. |
