66 AN ACT
77 relating to the recruitment and retention of certain caseworkers
88 employed by the Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Sections 40.0327 and 40.0328 to read as
1212 follows:
1313 Sec. 40.0327. PREEMPLOYMENT ASSESSMENT. The department
1414 shall use special assessment tools in screening applicants for
1515 employment with the division in order to match an applicant with the
1616 position in the division for which an applicant would be best suited
1717 based on the applicant's skills, personality traits, and
1818 experience.
1919 Sec. 40.0328. SALARY STUDY. (a) The department shall study
2020 the salaries of each type of child protective services caseworker
2121 to determine the role salary plays in the recruitment and retention
2222 of caseworkers and in the turnover rate for each type of caseworker.
2323 (b) Not later than December 1, 2010, the department shall
2424 report the results of the study and any recommendations to the
2525 governor, lieutenant governor, speaker of the house of
2626 representatives, and standing committee of each house with
2727 jurisdiction over the department.
2828 (c) The commission shall consider contracting with an
2929 institution of higher education, as defined by Section 61.003,
3030 Education Code, to perform the study required by this section.
3131 (d) This section expires September 1, 2011.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
