| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.022(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) The State Board of Education shall adopt a review and |
|---|
| 13 | 13 | | adoption cycle for textbooks for elementary grade levels, including |
|---|
| 14 | 14 | | prekindergarten, and secondary grade levels, for each subject in |
|---|
| 15 | 15 | | the required curriculum under Section 28.002. The cycle shall be |
|---|
| 16 | 16 | | organized to provide for the board to review and adopt electronic |
|---|
| 17 | 17 | | textbooks for a subject before the board reviews and adopts for a |
|---|
| 18 | 18 | | subject any textbook that is not an electronic textbook. |
|---|
| 19 | 19 | | SECTION 2. Section 31.022(a), Education Code, as amended by |
|---|
| 20 | 20 | | this Act, applies only to the public school textbook review and |
|---|
| 21 | 21 | | adoption cycle for a textbook for which the State Board of Education |
|---|
| 22 | 22 | | issues a proclamation under Subchapter B, Chapter 31, Education |
|---|
| 23 | 23 | | Code, on or after the effective date of this Act. The review and |
|---|
| 24 | 24 | | adoption cycle for a textbook for which the State Board of Education |
|---|
| 25 | 25 | | issues a proclamation before the effective date of this Act is |
|---|
| 26 | 26 | | governed by the law in effect when the proclamation was issued, and |
|---|
| 27 | 27 | | the former law is continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
