| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 62.092, Education Code, is amended to | |
| 9 | 9 | read as follows: | |
| 10 | 10 | Sec. 62.092. DEFINITIONS. In this subchapter: | |
| 11 | 11 | (1) "Coordinating board" means the Texas Higher Education | |
| 12 | 12 | Coordinating Board. | |
| 13 | 13 | (2) "Eligible institution" means a general academic teaching | |
| 14 | 14 | instiution, as defined by Section 61.003, other than The University | |
| 15 | 15 | of Texas at Austin or[,] Texas A&M University[, or Prairie View A&M | |
| 16 | 16 | University]. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2009. |
