| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 240, Local Government |
|---|
| 13 | 13 | | Code, is amended by adding Section 240.904 to read as follows: |
|---|
| 14 | 14 | | Sec. 240.904. REGULATION OF NUMBER OF DOGS AT RESIDENCE. |
|---|
| 15 | 15 | | (a) In this section, "residential subdivision" has the meaning |
|---|
| 16 | 16 | | assigned by Section 240.081. |
|---|
| 17 | 17 | | (b) The commissioners court of a county with a population of |
|---|
| 18 | 18 | | one million or more by order may limit the number of dogs that an |
|---|
| 19 | 19 | | individual may keep at a residence located in a residential |
|---|
| 20 | 20 | | subdivision in the unincorporated area of the county. |
|---|
| 21 | 21 | | (c) An order adopted under Subsection (b) does not apply to |
|---|
| 22 | 22 | | a residence used by a registered animal rescue group on a |
|---|
| 23 | 23 | | determination by the commissioners court that the neighborhood in |
|---|
| 24 | 24 | | which the residence is located does not operate an animal shelter. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
