66 AN ACT
77 relating to the powers and duties of the Legislative Budget Board,
88 including the receipt of reports by the board.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 316, Government Code, is
1111 amended by adding Section 316.010 to read as follows:
1212 Sec. 316.010. ADJUSTING THE COMPOSITION OF FUND AND ACCOUNT
1313 BALANCES. (a) The comptroller may, as necessary to ensure
1414 compliance with the limit on the rate of growth of appropriations
1515 prescribed by Section 22, Article VIII, Texas Constitution, adjust
1616 the composition of fund and account balances without making any net
1717 change in the amount of a fund or account balance and without
1818 changing the amount of an appropriation.
1919 (b) The comptroller shall report any adjustment made under
2020 Subsection (a) to the Legislative Budget Board.
2121 SECTION 2. Section 2054.102(a), Government Code, is amended
2222 to read as follows:
2323 (a) The Legislative Budget Board may specify procedures for
2424 the submission, review, approval, and disapproval of biennial
2525 operating plans and amendments, including procedures for review or
2626 reconsideration of the Legislative Budget Board's disapproval of a
2727 biennial operating plan or biennial operating plan amendment. [The
2828 Legislative Budget Board shall review and approve or disapprove the
2929 biennial operating plan or biennial operating plan amendment not
3030 later than the 60th day after the date the plan or amendment to the
3131 plan is submitted. The plan or amendment to the plan is considered
3232 to be approved on the 61st day after the date the plan or amendment
3333 is submitted if the Legislative Budget Board does not disapprove
3434 the plan or amendment before that date.]
3535 SECTION 3. Section 19.0041, Education Code, is amended to
3636 read as follows:
3737 Sec. 19.0041. EVALUATION OF TRAINING SERVICES. (a) To
3838 evaluate the effectiveness of training services provided to persons
3939 confined or imprisoned in the department, the Windham School
4040 District shall consult with the Criminal Justice Legislative
4141 Oversight Committee [Legislative Budget Board] to compile and
4242 analyze information for each person who receives the training
4343 services. This information shall include an evaluation of:
4444 (1) the kind of training services provided;
4545 (2) the kind of employment the person obtains on
4646 release;
4747 (3) whether the employment was related to training;
4848 (4) the difference between the amount of the person's
4949 earnings on the date employment is obtained following release and
5050 the amount of those earnings on the first anniversary of that date;
5151 and
5252 (5) the retention factors associated with the
5353 employment.
5454 (b) The district [Legislative Budget Board] shall submit an
5555 annual report to the Criminal Justice Legislative Oversight
5656 Committee, [legislature and] the governor's office, and the
5757 Legislative Budget Board based on data compiled and analyzed under
5858 Subsection (a).
5959 SECTION 4. Not later than December 1, 2009, the Windham
6060 School District shall submit the first report to the Criminal
6161 Justice Legislative Oversight Committee, the governor's office,
6262 and the Legislative Budget Board as required by Section 19.0041(b),
6363 Education Code, as amended by this Act.
6464 SECTION 5. Section 322.016(b), Government Code, is
6565 repealed.
6666 SECTION 6. This Act takes effect September 1, 2009.
