5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the powers and duties of the Legislative Budget Board,
8	8	including the receipt of reports by the board.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter A, Chapter 316, Government Code, is
11	11	amended by adding Section 316.010 to read as follows:
12	12	Sec. 316.010. ADJUSTING THE COMPOSITION OF FUND AND ACCOUNT
13	13	BALANCES. (a) The comptroller may, as necessary to ensure
14	14	compliance with the limit on the rate of growth of appropriations
15	15	prescribed by Section 22, Article VIII, Texas Constitution, adjust
16	16	the composition of fund and account balances without making any net
17	17	change in the amount of a fund or account balance and without
18	18	changing the amount of an appropriation.
19	19	(b) The comptroller shall report any adjustment made under
20	20	Subsection (a) to the Legislative Budget Board.
21	21	SECTION 2. Section 2054.102(a), Government Code, is amended
22	22	to read as follows:
23	23	(a) The Legislative Budget Board may specify procedures for
24	24	the submission, review, approval, and disapproval of biennial
25	25	operating plans and amendments, including procedures for review or
26	26	reconsideration of the Legislative Budget Board's disapproval of a
27	27	biennial operating plan or biennial operating plan amendment. [The
28	28	Legislative Budget Board shall review and approve or disapprove the
29	29	biennial operating plan or biennial operating plan amendment not
30	30	later than the 60th day after the date the plan or amendment to the
31	31	plan is submitted. The plan or amendment to the plan is considered
32	32	to be approved on the 61st day after the date the plan or amendment
33	33	is submitted if the Legislative Budget Board does not disapprove
34	34	the plan or amendment before that date.]
35	35	SECTION 3. Section 19.0041, Education Code, is amended to
36	36	read as follows:
37	37	Sec. 19.0041. EVALUATION OF TRAINING SERVICES. (a) To
38	38	evaluate the effectiveness of training services provided to persons
39	39	confined or imprisoned in the department, the Windham School
40	40	District shall consult with the Criminal Justice Legislative
41	41	Oversight Committee [Legislative Budget Board] to compile and
42	42	analyze information for each person who receives the training
43	43	services. This information shall include an evaluation of:
44	44	(1) the kind of training services provided;
45	45	(2) the kind of employment the person obtains on
46	46	release;
47	47	(3) whether the employment was related to training;
48	48	(4) the difference between the amount of the person's
49	49	earnings on the date employment is obtained following release and
50	50	the amount of those earnings on the first anniversary of that date;
51	51	and
52	52	(5) the retention factors associated with the
53	53	employment.
54	54	(b) The district [Legislative Budget Board] shall submit an
55	55	annual report to the Criminal Justice Legislative Oversight
56	56	Committee, [legislature and] the governor's office, and the
57	57	Legislative Budget Board based on data compiled and analyzed under
58	58	Subsection (a).
59	59	SECTION 4. Not later than December 1, 2009, the Windham
60	60	School District shall submit the first report to the Criminal
61	61	Justice Legislative Oversight Committee, the governor's office,
62	62	and the Legislative Budget Board as required by Section 19.0041(b),
63	63	Education Code, as amended by this Act.
64	64	SECTION 5. Section 322.016(b), Government Code, is
65	65	repealed.
66	66	SECTION 6. This Act takes effect September 1, 2009.
