55 relating to permits for the movement of oversize and overweight
66 vehicles in a certain county.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 623.252(b), Transportation Code, is
99 amended to read as follows:
1010 (b) A permit issued under this subchapter may authorize:
1111 (1) the transport of cargo only on the following roads
1212 in Chambers County:
1313 (A) Farm-to-Market Road 1405 between its
1414 intersection with Farm-to-Market Road 2354 and its intersection
1515 with Farm-to-Market Road 565; [and]
1616 (B) the frontage road of State Highway 99 located
1717 in the Cedar Crossing Business Park;
1818 (C) Farm-to-Market Road 565 from its
1919 intersection with Farm-to-Market Road 1405 east approximately
2020 6,200 linear feet to the western edge of the 10-foot pipeline
2121 easement recorded at volume 351, page 760, of the Chambers County
2222 deed records; and
2323 (D) Farm-to-Market Road 2354 from its
2424 intersection with Farm-to-Market Road 1405 northwest approximately
2525 300 linear feet to the termination of the state-maintained portion
2626 of the road; and
2727 (2) the movement of equipment and commodities weighing
2828 100,000 pounds or less.
2929 SECTION 2. Section 623.255(a), Transportation Code, is
3030 amended to read as follows:
3131 (a) A permit issued under this subchapter must include:
3232 (1) the name of the applicant;
3333 (2) the date of issuance;
3434 (3) the signature of the designated agent for the
3535 county;
3636 (4) a statement of the kind of cargo being
3737 transported, the maximum weight and dimensions of the equipment,
3838 and the kind and weight of each commodity to be transported;
3939 (5) a statement of any condition on which the permit is
4040 issued;
4141 (6) a statement that the cargo may be transported in
4242 Chambers County only over the roads described by Section
4343 623.252(b)(1) [Farm-to-Market Road 1405 and the frontage road of
4444 State Highway 99 located in the Cedar Crossing Business Park]; and
4545 (7) the location where the cargo was loaded.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
