7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Section 623.252(b), Transportation Code, is |
---|
9 | 9 | | amended to read as follows: |
---|
10 | 10 | | (b) A permit issued under this subchapter may authorize: |
---|
11 | 11 | | (1) the transport of cargo only on the following roads |
---|
12 | 12 | | in Chambers County: |
---|
13 | 13 | | (A) Farm-to-Market Road 1405 between its |
---|
14 | 14 | | intersection with Farm-to-Market Road 2354 and its intersection |
---|
15 | 15 | | with Farm-to-Market Road 565; [and] |
---|
16 | 16 | | (B) the frontage road of State Highway 99 located |
---|
17 | 17 | | in the Cedar Crossing Business Park; |
---|
18 | 18 | | (C) Farm-to-Market Road 565 from its |
---|
19 | 19 | | intersection with Farm-to-Market Road 1405 east approximately |
---|
20 | 20 | | 6,200 linear feet to the western edge of the 10-foot pipeline |
---|
21 | 21 | | easement recorded at volume 351, page 760, of the Chambers County |
---|
22 | 22 | | deed records; and |
---|
23 | 23 | | (D) Farm-to-Market Road 2354 from its |
---|
24 | 24 | | intersection with Farm-to-Market Road 1405 northwest approximately |
---|
25 | 25 | | 300 linear feet to the termination of the state-maintained portion |
---|
26 | 26 | | of the road; and |
---|
27 | 27 | | (2) the movement of equipment and commodities weighing |
---|
28 | 28 | | 100,000 pounds or less. |
---|
29 | 29 | | SECTION 2. Section 623.255(a), Transportation Code, is |
---|
30 | 30 | | amended to read as follows: |
---|
31 | 31 | | (a) A permit issued under this subchapter must include: |
---|
32 | 32 | | (1) the name of the applicant; |
---|
33 | 33 | | (2) the date of issuance; |
---|
34 | 34 | | (3) the signature of the designated agent for the |
---|
35 | 35 | | county; |
---|
36 | 36 | | (4) a statement of the kind of cargo being |
---|
37 | 37 | | transported, the maximum weight and dimensions of the equipment, |
---|
38 | 38 | | and the kind and weight of each commodity to be transported; |
---|
39 | 39 | | (5) a statement of any condition on which the permit is |
---|
40 | 40 | | issued; |
---|
41 | 41 | | (6) a statement that the cargo may be transported in |
---|
42 | 42 | | Chambers County only over the roads described by Section |
---|
43 | 43 | | 623.252(b)(1) [Farm-to-Market Road 1405 and the frontage road of |
---|
44 | 44 | | State Highway 99 located in the Cedar Crossing Business Park]; and |
---|
45 | 45 | | (7) the location where the cargo was loaded. |
---|
46 | 46 | | SECTION 3. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 50 | | Act takes effect September 1, 2009. |
