| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter E, Chapter 37, Education Code, is | |
| 11 | 11 | amended by adding Section 37.1205 to read as follows: | |
| 12 | 12 | Sec. 37.1205. CULPABLE MENTAL STATES. As provided by | |
| 13 | 13 | Section 1.03(b), Penal Code, the definitions of culpable mental | |
| 14 | 14 | states provided by Section 6.03, Penal Code, apply to offenses | |
| 15 | 15 | defined by this code. | |
| 16 | 16 | SECTION 2. The amendment by this Act to Subchapter E, | |
| 17 | 17 | Chapter 37, Education Code, is intended to clarify rather than | |
| 18 | 18 | change existing law. | |
| 19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
