| 7 | 7 | | relating to the composition of the board of the Texas School Safety |

| 8 | 8 | | Center and the terms of certain members of the board. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 37.203(a), Education Code, as amended by |
|---|
| 11 | 11 | | Chapters 258 (S.B. 11) and 263 (S.B. 103), Acts of the 80th |
|---|
| 12 | 12 | | Legislature, Regular Session, 2007, is reenacted to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) The center is advised by a board of directors composed |
|---|
| 15 | 15 | | of: |
|---|
| 16 | 16 | | (1) the attorney general, or the attorney general's |
|---|
| 17 | 17 | | designee; |
|---|
| 18 | 18 | | (2) the commissioner, or the commissioner's designee; |
|---|
| 19 | 19 | | (3) the executive director of the Texas Juvenile |
|---|
| 20 | 20 | | Probation Commission, or the executive director's designee; |
|---|
| 21 | 21 | | (4) the executive commissioner of the Texas Youth |
|---|
| 22 | 22 | | Commission, or the executive commissioner's designee; |
|---|
| 23 | 23 | | (5) the commissioner of the Department of State Health |
|---|
| 24 | 24 | | Services, or the commissioner's designee; |
|---|
| 25 | 25 | | (6) the commissioner of higher education, or the |
|---|
| 26 | 26 | | commissioner's designee; and |
|---|
| 27 | 27 | | (7) the following members appointed by the governor |
|---|
| 28 | 28 | | with the advice and consent of the senate: |
|---|
| 29 | 29 | | (A) a juvenile court judge; |
|---|
| 30 | 30 | | (B) a member of a school district's board of |
|---|
| 31 | 31 | | trustees; |
|---|
| 32 | 32 | | (C) an administrator of a public primary school; |
|---|
| 33 | 33 | | (D) an administrator of a public secondary |
|---|
| 34 | 34 | | school; |
|---|
| 35 | 35 | | (E) a member of the state parent-teacher |
|---|
| 36 | 36 | | association; |
|---|
| 37 | 37 | | (F) a teacher from a public primary or secondary |
|---|
| 38 | 38 | | school; |
|---|
| 39 | 39 | | (G) a public school superintendent who is a |
|---|
| 40 | 40 | | member of the Texas Association of School Administrators; |
|---|
| 41 | 41 | | (H) a school district police officer or a peace |
|---|
| 42 | 42 | | officer whose primary duty consists of working in a public school; |
|---|
| 43 | 43 | | and |
|---|
| 44 | 44 | | (I) two members of the public. |
|---|
| 45 | 45 | | SECTION 2. Section 37.203(b), Education Code, is amended to |
|---|
| 46 | 46 | | read as follows: |
|---|
| 47 | 47 | | (b) Members of the board appointed under Subsection (a)(7) |
|---|
| 48 | 48 | | [(a)(6)] serve staggered two-year terms, with the terms of the |
|---|
| 49 | 49 | | members described by Subsections (a)(7)(A)-(E) [(a)(6)(A)-(E)] |
|---|
| 50 | 50 | | expiring on February 1 of each odd-numbered year and the terms of |
|---|
| 51 | 51 | | the members described by Subsections (a)(7)(F)-(I) |
|---|
| 52 | 52 | | [(a)(6)(F)-(I)] expiring on February 1 of each even-numbered year. |
|---|
| 53 | 53 | | A member may serve more than one term. |
|---|
| 54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2009. |
