9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 34, Education Code, is amended by adding | |
11 | 11 | Section 34.016 to read as follows: | |
12 | 12 | Sec. 34.016. LOCATION OF BUS STOP. (a) When designating the | |
13 | 13 | location of a bus stop, a school district shall consider the | |
14 | 14 | proximity of the bus stop to the residence of an individual as to | |
15 | 15 | whom the district superintendent or a school administrator has | |
16 | 16 | received notice under Article 62.054, Code of Criminal Procedure. | |
17 | 17 | (b) The district shall attempt to locate each bus stop at | |
18 | 18 | least 1,500 feet from the residence of an individual described by | |
19 | 19 | Subsection (a), as measured in a straight line from the nearest | |
20 | 20 | property line of the residence to the bus stop. | |
21 | 21 | SECTION 2. This Act applies beginning with the 2009-2010 | |
22 | 22 | school year. | |
23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2009. |
