| 9 | 9 | SECTION 1. Chapter 511.0094, Government Code, is amended by | |
| 10 | 10 | amending Sec. 511.0094 to read as follows: | |
| 11 | 11 | Sec. 511.0094. EXCLUSION OF JAILS OR CORRECTIONAL | |
| 12 | 12 | FACILITIES HOUSING ONLY FEDERAL PRISONERS. The provisions of this | |
| 13 | 13 | chapter do not apply to a correctional facility contracting to | |
| 14 | 14 | house only federal prisoners and operating pursuant to a contract | |
| 15 | 15 | between a unit of the federal government and a county, a | |
| 16 | 16 | municipality, or a private vendor. If a county or a municipality | |
| 17 | 17 | contracts to house or begins to house only federal prisoners the | |
| 18 | 18 | provisions of this chapter do apply. If a county, municipality, or | |
| 19 | 19 | private vendor contracts to house or begins to house state, county, | |
| 20 | 20 | or municipal prisoners or prisoners of another state of the United | |
| 21 | 21 | States, it shall report to the commission before placing such | |
| 22 | 22 | inmates in a correctional facility housing only federal prisoners. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2009. |
