55 AN ACT
66 relating to the authority of the Commission on State Emergency
77 Communication to determine the 9-1-1 service fee.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sec. 771.071(b), Health & Safety Code, is
1010 amended to read as follows:
1111 (b) The amount of the fee may not exceed [50] 40 cents a
1212 month for each line.
1313 SECTION 2. Sec. 771.0711(b), Health & Safety Code, is
1414 amended to read as follows:
1515 (b) A wireless service provider shall collect the fee in an
1616 amount equal to [50] 40 cents a month for each wireless
1717 telecommunications connection from its subscribers and shall pay
1818 the money collected to the comptroller not later than the 30th day
1919 after the last day of the month during which the fees were
2020 collected. The comptroller may establish alternative dates for
2121 payment of fees under this section. The wireless service provider
2222 may retain an administrative fee of one percent of the amount
2323 collected. The comptroller shall deposit the money from the fees to
2424 the credit of the 9-1-1 services fee account. Until deposited to
2525 the credit of the 9-1-1 services fee account as required by
2626 Subsection (c), money the comptroller collects under this
2727 subsection remains in a trust fund with the state treasury.
2828 SECTION 3. This Act applies only to fees imposed on or after
2929 the effective date of this Act. Fees imposed before that date are
3030 governed by the law in effect on the date the fees were imposed, and
3131 that law is continued in effect for that purpose.
3232 SECTION 4. This Act takes effect September 1, 2009.
