77 relating to the use of personal leave by a public school employee.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 22.003, Education Code, is amended by
1010 amending Subsection (a) and adding Subsection (f) to read as
1111 follows:
1212 (a) A state minimum personal leave program consisting of
1313 five days per year personal leave with no limit on accumulation and
1414 transferable among districts shall be provided for school district
1515 employees. School districts may provide additional personal leave
1616 beyond this minimum. The board of trustees of a school district may
1717 adopt a policy governing an employee's use of personal leave
1818 granted under this subsection, except that the policy may not
1919 restrict:
2020 (1) the purposes for which the leave may be used; or
2121 (2) the order in which an employee may use the state
2222 minimum personal leave and any additional personal leave provided
2323 by the school district.
2424 (f) A public school employee who retains any sick leave
2525 accumulated under former Section 13.904(a), as that section existed
2626 on January 1, 1995, is entitled to use the sick leave provided under
2727 that section or the personal leave provided under Subsection (a) in
2828 any order to the extent that the leave the employee uses is
2929 appropriate to the purpose of the leave.
3030 SECTION 2. This Act applies beginning with the 2009-2010
3131 school year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
