66 AN ACT
77 relating to certain billing practices by businesses in this state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle A, Title 5, Business & Commerce Code, is
1010 amended by adding Chapter 74 to read as follows:
1111 CHAPTER 74. BILLING PRACTICES
1212 Sec. 74.001. NO EXTRA CHARGE FOR PAPER INVOICE. (a) A
1313 business in this state:
1414 (1) must include within its basic fee for goods or
1515 services purchased by a customer any cost associated with providing
1616 the customer a paper invoice or similar document for the goods or
1717 services; and
1818 (2) may not impose an extra charge for the service of
1919 providing its customer a paper invoice or similar document for the
2020 goods or services.
2121 (b) Subsection (a) applies to the provision of a paper
2222 invoice or similar document to a customer without regard to how the
2323 invoice or document is physically delivered to the customer,
2424 including by mail.
2525 (c) This section does not apply to billing for goods or
2626 services purchased by a customer through the Internet.
2727 Sec. 74.002. DISCOUNT FOR PAPERLESS BILLING. Section
2828 74.001 does not prevent a business from offering a discount to a
2929 customer who agrees:
3030 (1) not to receive a paper invoice or similar document
3131 for goods or services purchased by the customer; and
3232 (2) to receive the invoice or similar document in an
3333 electronic form over the Internet.
3434 SECTION 2. This Act applies only to a charge for a bill that
3535 is issued on or after the effective date of this Act.
3636 SECTION 3. This Act takes effect September 1, 2009.
