| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 33.093 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.093. PHYSICAL EXAMINATION REQUIRED FOR |
|---|
| 13 | 13 | | PARTICIPATION IN CERTAIN EXTRACURRICULAR ATHLETIC ACTIVITIES. (a) |
|---|
| 14 | 14 | | A student may not participate in an extracurricular athletic |
|---|
| 15 | 15 | | activity involving physical contact among the players, including an |
|---|
| 16 | 16 | | athletic practice, scrimmage, game, or match for such an activity, |
|---|
| 17 | 17 | | sponsored or sanctioned by the University Interscholastic League |
|---|
| 18 | 18 | | unless the student has submitted to the school district in which the |
|---|
| 19 | 19 | | student attends school a completed form indicating that the student |
|---|
| 20 | 20 | | has received a physical examination, including a cognitive |
|---|
| 21 | 21 | | assessment. |

| 22 | 22 | | (b) A student must submit a form under this section for each |
|---|
| 23 | 23 | | school year in which the student participates in an extracurricular |
|---|
| 24 | 24 | | athletic activity to which this section applies. |
|---|
| 25 | 25 | | (c) The University Interscholastic League shall adopt rules |
|---|
| 26 | 26 | | to administer this section, including rules specifying the athletic |
|---|
| 27 | 27 | | activities that involve physical contact among the players. |
|---|
| 28 | 28 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 29 | 29 | | school year. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
