66 AN ACT
77 relating to the state employee wellness program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 664.053(b), Government Code, is amended
1010 to read as follows:
1111 (b) The statewide wellness coordinator shall:
1212 (1) coordinate with other agencies that administer a
1313 health benefits program under Chapter 1551, Insurance Code, as
1414 necessary to develop the model wellness program, prevent
1515 duplication of efforts, provide information and resources to
1616 employees, and encourage the use of wellness benefits included in
1717 the health benefits program;
1818 (2) maintain a set of Internet links to health
1919 resources for use by state employees;
2020 (3) design an outreach campaign to educate state
2121 employees about health and fitness-related resources, including
2222 available exercise facilities, online tools, and health and
2323 fitness-related organizations;
2424 (4) study the implementation and participation rates
2525 of state agency worksite wellness programs and report the findings
2626 to the legislature biennially; [and]
2727 (5) organize an annual conference hosted by the
2828 department for all state agency wellness councils; and
2929 (6) create an online questionnaire for state agency
3030 heads to report information, including:
3131 (A) the agency policy on leave time for employees
3232 to complete a health risk assessment;
3333 (B) the agency policy on leave time for employees
3434 to receive an annual physical examination;
3535 (C) the agency policy on providing employees time
3636 during the workday to exercise; and
3737 (D) whether the agency has a wellness coordinator
3838 or council.
3939 SECTION 2. Section 664.061, Government Code, is amended to
4040 read as follows:
4141 Sec. 664.061. AGENCY WELLNESS POLICIES. (a) A state agency
4242 shall create a worksite wellness policy that is annually updated
4343 and submitted to the statewide wellness coordinator.
4444 (b) The executive head of a state agency shall submit the
4545 agency's worksite wellness information to the statewide wellness
4646 coordinator annually through the online questionnaire under
4747 Section 664.053(b)(6).
4848 (c) A state agency may:
4949 (1) allow each employee 30 minutes during normal
5050 working hours for exercise three times each week;
5151 (2) allow all employees to attend on-site wellness
5252 seminars when offered; and
5353 (3) provide four [eight] hours of additional leave
5454 time each year to an employee who [:
5555 [(A)] receives a physical examination.
5656 (d) A state agency shall provide four hours of leave time
5757 each year to an employee who [; and
5858 [(B)] completes either an online health risk
5959 assessment tool provided by the board or a similar health risk
6060 assessment conducted in person by a worksite wellness coordinator.
6161 SECTION 3. This Act takes effect September 1, 2009.
